<br />001035857 04/05/90 ':41 PM REAL ESTATF~ECORDS <br />F1 (,;0:21 CHARLOTTE HOL.. j'ON BOULDEF~ CNT"'( [:0 ,.,CORDER <br /> <br />ORDINANCE NO. 1026 <br /> <br />'3/ \ <br /> <br />AN ORDINANCE ADOPTI.NG STANDARDS FOR THE <br />ISSUANCE OF OPTIONAL PREMISES LICENSES AND <br />FOR OPTIONAL PREMISES FOR A HOTEL AND <br />RESTAURANT LICENSE PURSUANT TO THE PROVISIONS <br />% ~~~& 12-47-135.5 C.R.S., AS AMENDED; AND DECIARING <br /> <br />WHEREAS, Section 12'-47-135,5 C.R.S., as amended permits <br />a municipality to adopt standards for the issuance of optional <br />premises licenses or for optional premises for a hotel or <br />restaurant license for outdoor sport or recreational facilities, <br />as defined in Section 12-47-(13,5)(c); and <br /> <br />WHEREAS, the City of Louisville wishes to adopt such <br />standards: <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO AS FOLLOWS: <br /> <br />Section 1 <br />The following standards for the issuance of optional <br />premises licenses or for optional premises for a hotel and <br />restaurant licenses are hereby adopted pursuant to the provisions <br />of Section 12-47-135.5 C,R.S., as amended <br /> <br />A. These standards adopted herein shall be considered <br />in addition to all other standards applicable to the issuance of <br />licenses under the Colorado Liquor Code for optional premises <br />license or for optional premises for a hotel and restaurant <br />license. These two types of licenses for optional premises will <br />COllectively be referred to as "optional premises" in these <br />standards unless otherwise provided. <br /> <br />B. Eligible Facilities. An optional premises may <br />only be approved when that premises is located on or adjacent to <br />an outdoor sports and recreational facility as defined in Section <br />12-47-(13,5)(c). The types of outdoor sports and recreational <br />facilities which may be considered for an outdoor premises <br />license include the following: <br /> <br />1. Country clubs <br />3. Golf Courses and Driving Ranges <br />3. Swimming Pools <br /> <br />There are not restrictions on the m~n~mum size of the <br />outdoor sports and recreational facilities which may be eligible <br />for the approval of an optional premises license. However, the <br />local licensing authority may consider the size of the particular <br />outdoor sports or recreational facility in relationship to the <br />number of optional premises requested for the facility, <br /> <br />C. Number of optional premises. There are no <br />restrictions on the number of optional premises which anyone <br /> <br />1 <br />
