ORDINANCE NO. 1671 SERIES 2014 AN ORDINANCE APPROVING THE VACATION OF A 40-FOOT BY 452.92-FOOT RIGHT-OF-WAY FOR NORTH FRONT STREET DEDICATED TO THE CITY BY THE PLAT OF THE INDUSTRIAL AREA SUBDIVISION IN THE CITY OF LOUISVILLE WHEREAS, by the plat of Industrial Area Subdivision, recorded January 22, 1960, in Plat Book 7 at Page 58, Boulder County Records, there was dedicated to the City a 40-foot wide by 452.92-foot long right-of-way for North Front Street lying on the western border of said subdivision along and adjacent to the Burlington Northern Railroad right-of-way, which 18,1 16.80 square-foot area of North Front Street right-of-way is further described and depicted on Exhibit A and hereafter referred to as the"Street Right-of-Way;"and WHEREAS,proper application has been made to the City for vacation of the Street Right- of-Way; and WHEREAS, the City Council has determined that the Street Right-of-Way for which vacation has been requested is not and has not been used or required as a roadway or thoroughfare for the public;and WHEREAS, the City Council has determined that the Street Right-of-Way for which vacation is requested is not and will not be needed for any public purposes other than for the installation, operation,maintenance,repair, upgrading and replacement of existing and future public utilities;and WHEREAS, the City Council has determined that the Street Right-of-Way for which vacation is requested is not being used or held for park purposes or for any other governmental purposes;and WHEREAS, the City Council desires to approve the application and vacate the City's interests in the Street Right-of-Way described herein for which vacation is requested, subject to the provisions of this Ordinance; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. Subject to the provisions of Section 2 hereof, the City hereby vacates that certain 40-foot wide by 45292-foot long North Front Street right-of-way dedicated to the City by the plat of Industrial Area Subdivision, recorded January 22, 1960, in Plat Book 7 at Page 58, Boulder County Records and lying on the western border of said subdivision along and adjacent to the Burlington Northern Railroad right-of-way, which 18,116.80 square-foot area of North Front: Street right-of-way hereby vacated is further described and depicted on Exhibit A (the "Street: Right-of-Way")
