RESOLUTION N0.3 <br />SERIES 2008 <br />A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT (PUD) <br />DEVELOPMENT PLAN FOR THE DEVELOPMENT OF AN 84,430 SF TWO-STORY <br />FLEX/OFFICE BUILDING ON LOTS 6 AND 7, CTC FILING N0.2. <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final planned unit development (PUD) plan to construct an 84,430 SF flex office <br />building on Lots 6 and 7, CTC Filing No. 2; and <br />WHEREAS, all materials related to the final PUD development plan have been <br />reviewed by City Staff and the Planning Commission and found, to be in compliance with the <br />Louisville zoning ordinances, the Industrial Development Design Standards and Guidelines, <br />related policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said final PUD <br />development plan on November 8, 2007, where evidence and testimony were entered into the <br />public record, including the staff report dated November 8, 2007, the Planning Commission <br />recommended approval to the City Council, with the following conditions: <br />1. This project developer is responsible for the placement of landscaping in the conservation <br />easement along Dillon Road and the right-of--way landscaping along CTC Boulevard. <br />The landscaping will have to be installed at time of building development. <br />2. A Covenant Agreement will be required to consolidate the two properties; and <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and that the application should be approved, with the following <br />conditions: <br />1. This project developer is responsible for the placement of landscaping in the conservation <br />easement along Dillon Road and the right-of--way landscaping along CTC Boulevard. <br />The landscaping will have to be installed at time of building development. <br />2.
