RESOLUTION NO. 36 <br />SERIES 2016 <br />A RESOLUTION DENYING A REPLAT TO SUBDIVIDE A SINGLE 15,000 SF LOT <br />INTO TWO SEPARATE LOTS IN THE RESIDENTIAL LOW (RL) ZONE DISTRICT, <br />LOCATED AT 105 ROOSEVELT AVENUE, LOTS 15-17 & 10 FT VACATED ALLEY, <br />BLOCK 4, JOHNSON'S FIRST ADDITION <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a replat to subdivide a single 15,000 SF lot into two separate <br />lots in the Residential Low (RL) zone district, located at 105 Roosevelt Avenue, Lots 15- <br />17 & 10 ft vacated alley, Block 4, Johnson's First Addition; and <br />WHEREAS, the City Council held a properly noticed public hearing on July 19, <br />2016, where evidence and testimony were entered into the record, including without <br />limitation the application and supporting materials, the Louisville City Council staff report <br />dated July 19, 2016 and all attachments included with such staff report; applicable <br />provisions of the City comprehensive plan and the City subdivision and zoning <br />ordinances set forth in titles 16 and 17 of the Louisville Municipal Code; and additional <br />written statements and other documents, as well as testimony from the staff and <br />applicant; and <br />WHEREAS, the City Council by this Resolution desires to set forth its findings, <br />conclusions and ruling with respect to the application. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The foregoing recitals are incorporated herein. <br />Section 2. Based on the testimony of the witnesses and the documents and <br />other evidence made a part of the record of the hearing before the City Council, the City <br />Council finds as follows: <br />a. The application is for replat to subdivide a single 15,000 SF lot into two <br />separate lots in the Residential Low (RL) zone district, located at 105 Roosevelt <br />Avenue, Lots 15-17 & 10 ft vacated alley, Block 4, Johnson's First Addition. The <br />property is owned by Creel E Kerss. The applicant is Creel E Kerss. <br />b. The property that is the subject of the application is zoned Residential Low <br />(RL). Section 17.12.040 of Title 17, Zoning, of the Louisville Municipal Code (LMC) sets <br />minimum lot area and minimum lot width requirements for the RL zone district. <br />c. The property that is the subject of the application is 100' x 150', currently <br />conforms to applicable requirements of Title 17, and is occupied by an existing house. <br />Resolution No. 36, Series 2016 <br />Page 1 of 3 <br />
