RESOLUTION NO. 59 <br />SERIES 2016 <br />A RESOLUTION AMENDING SECTION 2.0 OF RESOLUTION NO. 16, <br />SERIES 2009, DEFINING CAUSE FOR PURPOSES OF SECTION 10-2(B) OF <br />THE LOUISVILLE HOME RULE CHARTER <br />WHEREAS, the Section 10-2(b) of the Louisville Home Rule Charter provides <br />that during the term of office, a member of a board or commission established by or <br />pursuant to Section 10-1 of the Charter shall be removed only for cause as defined by <br />resolution; and <br />WHEREAS, Resolution No. 16, Series 2009 defines causes for removal of a <br />member of a board or commission to include unexcused absences for more than 25 <br />percent of the regular meetings in any 12 -month period ; and <br />WHEREAS, City Council by this resolution desires to amend Resolution No. 16, <br />Series 2009 to remove the word "Unexcused" from such provision in order to facilitate <br />consistent application of attendance rules for boards and commissions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 2.0 of Resolution No. 16, Series 2009 is hereby amended to <br />read as follows (words added are underlined; words deleted are ): <br />C. Unexsuseel—QAbsence from more than 25 percent of the regular <br />meetings in any 12 -month period; <br />Section 2. In the event of any direct conflict between this resolution and any <br />resolution, rule or bylaw heretofore adopted, the provisions of this resolution shall <br />control. <br />PASSED AND ADOPTED this 15th day of November, 2016. <br />ATTEST: <br />i� <br />Robert P.
