RESOLUTION NO 27 <br />SERIES 2019 <br />A RESOLUTION APPROVING A ONE-YEAR EXTENSION TO THE 824 SOUTH <br />STREET/957 MAIN STREET PLANNED UNIT DEVELOPMENT AND AN <br />AMENDMENT TO THE SPECIAL REVIEW USE FOR OUTDOOR SALES OF RETAIL <br />GOODS AND EATING AND DRINKING ESTABLISHMENTS <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application requesting approval of a one-year extension to the PUD and an amendment <br />to the SRU for outdoor sales of retail goods and eating and drinking establishments at <br />824 South Street; and <br />WHEREAS, the City Staff has reviewed the information submitted and found that <br />the application complies, with conditions, with the Louisville zoning and subdivision <br />regulations and other applicable sections of the Louisville Municipal Code, and <br />WHEREAS, after a duly noticed public hearing on July 11, 2019, where evidence <br />and testimony were entered into the record, including the findings in the Louisville <br />Planning Commission Staff Report dated July 11, 2019, the Planning Commission <br />recommended approval the PUD extension and SRU Amendment, with two conditions, <br />and <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that said Planned Unit <br />Development extension and SRU Amendment should be approved <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approve a one-year extension to the PUD and an amendment to <br />the SRU for outdoor sales of retail goods and eating and drinking establishments at 824 <br />South Street, with the following conditions <br />1 The access area for the handicap parking space shall be moved on to the <br />property if the City, at its sole discretion, determines in the future that the access <br />area unduly restricts the public sidewalk after the project is completed and in use <br />or determines an alternative use of the right of way is desired The property <br />owner shall be responsible for all costs associated with relocation of the parking <br />space, including restoration of the public right-of-way and payment of the parking <br />fee -in -lieu that is in place at the time the determination to relocate the parking <br />space is made <br />2 The SRU amendment shall not be effective nor recorded with the Boulder County <br />Clerk and Recorder prior to approval of the PUD Amendment authorizing <br />changes to the site plan <br />Resolution No. 27, Series 2019 <br />Page 1 of 2 <br />
