ORDINANCE NO. 1279 SERIES 1998 AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE OF A PARCEL OF LAND OWNED BY THE CITY OF LOUISVILLE WHEREAS, the City is the owner of certain real property consisting of the northeast'one-quarter of the vacated right-of-way for 80th Street lying between Dillon Road and U.S. 36, as more particularly described in Exhibit A attached hereto (the "City Parcel"); and WHEREAS, the City of Louisville and Colony Square, LLC have entered into an Agreement to Exchange Real Estate which provides that the City will convey the City Parcel to Colony Square in exchange for certain real property owned by Colony Square, LLC and for other consideration set forth in such Agreement; and WHEREAS, the City Council has determined that the property described in Exhibit A is not and will not be needed for any public purposes, and is not being used or held for park purposes or any other governmental purpose; and WHEREAS, the City Council by this ordinance desires to approve the sale and conveyance of the City Parcel, as required by C.R.S. §31-15-712. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: ~u%J~gP~l~ The City Council hereby approves the sale and conveyance from the City of Louisville to Colony Square, LLC, of that certain parcel of real property currently owned by the City and described in Exhibit A, attached hereto and incorporated herein by reference. ~ The sale and conveyance shall be upon the terms and conditions set forth in that certain Agreement to Exchange Real Estate between the City and Colony Square, LLC, which Agreement was approved by City Council Resolution No. 8, Series 1998, which terms and conditions are incorporated herein by reference as though set forth in full. ~_~. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid.
