SERIES 2001 PORTION OF RECORDED DOCUMENT <br /> MAY NOT REPRODUCE LEGIB'LY, <br /> <br /> AN ORDINANCE DISCONNECTING FROM THE CITY OF LOUISVILLE, <br /> COLORADO, CERTAIN PARCELS OF LAND REFERRED TO AS THE <br /> GLACIER PARK, BOULDER COUNTY LAND VENTURE AND <br /> TRILLIUM OPEN SPACE PROPERTIES <br /> <br /> WHEREAS, On April 19, 2001, the Board of County Commissioners of the County of <br />Boulder submitted to the City a Petition for Disconnection of Certain Open Space Lands, <br />petitioning for the enactment of an ordinance pursuant to C.R.S. § 31-12-501 disconnecting certain <br />lands from the corporate boundaries of the City of Louisville; and <br /> <br /> WHEREAS, the parcels of land subject to the petition to disconnect consist of the <br />properties legally described in Exhibit A attached hereto, which properties are commonly referred <br />to as the Glacier Park, Boulder County Land Venture and Trillium Open Space properties; and <br /> <br /> WHEREAS, the County of Boulder is the owner of the properties for which disconnection <br />is requested, except that the City of Louisville is the owner of those portions of the Trillium Open <br />Space property referred to as Trillium Parcel 1 and Trillium Parcel 2, as described in Exhibit A <br />attached hereto; and <br /> <br /> WHEREAS, in accordance with the Intergovernmental Agreement between the City of <br />Louisville and Boulder County dated June 17, 1999, the City and Boulder County will each acquire <br />an undivided 50% interest in the entirety of the Trillium and Boulder County Land Venture Open <br />Space properties (not including the Northwest Parkway right-of-way), and will acquire conservation <br />easements on the other party's undivided 50% interest in such properties; and <br /> <br /> WHEREAS, pursuant to C.R.S. §31-12-501, the City Council has given due consideration <br />to the petition; and <br /> <br /> WHEREAS, the City Council finds and determines that the best interests of the City and its <br />citizens will not be prejudiced by the disconnection of the Glacier Park, Boulder County Land <br />Venture and Trillium Open Space properties, including the Trillium Parcel 1 and Trillium Parcel 2 <br />parcels owned by the City, and that the disconnection of such parcels should be effected by <br />ordinance. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1, Pursuant to C.R.S. §31-12-501, that certain real property described in <br />Exhibit A, attached hereto and incorporated herein by this reference, is hereby disconnected from <br />the City of Louisville, Colorado, and is excluded from the corporate boundaries of the City. <br /> <br /> <br />
