ORDINANCE NO. 1436 <br /> SERIES 2003 <br /> <br />AN ORDINANCE REPEALING AND REENACTING CHAPTER 3.18 OF THE LOUISVILLE <br />MUNICIPAL CODE TO ESTABLISH DEVELOPMENT IMPACT FEES FOR MUNICIPAL <br />CAPITAL FACILITIES, POLICE CAPITAL FACILITIES, AND TRANSPORTATION CAPITAL <br />FACILITIES. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br /> <br />that: <br /> <br />Section <br /> <br />1. Legislative Findings: The City Council of the City of Louisville, Colorado finds - <br /> <br />New Development Placing Demand on City's Municipal Capital Facilities, Police <br />Capital Facilities, and Transportation Capital Facilities. <br />New development in the City is placing and is projected to place an increased demand upon <br />the City's Municipal Capital Facilities, Police Capital Facilities, and Transportation Capital <br />Facilities. <br /> <br />Need for Expansion of these Capital Facilities to Protect Health, Safety and Welfare. <br />The protection of the health, safety, and general welfare of the citizens of the City requires <br />that these Capital Facilities be expanded to accommodate and serve this continuing growth <br />within the City from new development. <br /> <br />Revenue Shortfall. <br />The tax and other revenues generated from new development does not generate sufficient <br />funds to provide the necessary City Municipal Capital Facilities, Police Capital Facilities, or <br />Transportation Capital Facilities to accommodate and serve new development. <br /> <br />Impact Fees Preferred Method. <br />The adoption of an equitable Impact Fee system consistent with the requirements of <br />applicable law is one of the preferred methods of the City for regulating land development <br />to ensure new development pays a proportionate and fair share of the costs of the needed <br />Capital Facilities, allowing the City to make the necessary Capital Facility expenditures to <br />serve new development. <br /> <br />Impact Fee Study to Support Impact Fees. <br />In order to implement an equitable Impact Fee system, the City has prepared Impact Fees: <br />City of Louisville, Colorado (hereinafter "Impact Fee Study"), dated September 3, 2003. Based on <br />reasonable methodologies and analyses for determining the impacts of new development on <br />the City's Municipal Capital Facilities, Police Capital Facilities, and Transportation Capital <br />FaciLities, the Impact Fee Study quantifies the reasonable impacts of new development on <br />these Capital Facilities, and establishes an Impact Fee no greater than is necessary to defray <br />the projected impacts on these Capital Facilities directly related to proposed new <br />development. <br /> <br />Standards Assumptions and LOS Standards in Impact Fee Study adopted as City <br />Standards. <br />The City hereby establishes as City standards the assumptions and Level of Service (LOS) <br />standards referenced in the Impact Fee Study as part of its current plans for future expansions <br /> <br /> <br />
