ORDINANCE NO. 1400 SERIES 2002 AN ORDINANCE AMENDING SECTION 17.56.070 OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT AN UPDATED FLOOD INSURANCE RATE MAP FOR THE CITY OF LOUISVILLE WHEREAS, the City has been advised by the Federal Emergency Management Agency (FEMA) that the City's floodplain regulations must be amended to adopt FEMA's updated flood insurance study and flood insurance rate map for the City; and WHEREAS, the City by this ordinance desires to adopt such updated study and map and amend its floodplain regulations accordingly. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Section 17.56.070 of the Louisville Municipal Code is hereby amended to read as follows (words added are underlined; words deleted are stricken tbteagb~): Sec. 17.56.070 Establishment of official maps. The location and boundaries of areas within the flood regulatory district are identified by the Federal Emergency Management Agency in a scientific and engineering report entitled "The Flood Insurance Study for Louisville," dated October 4, 2002J-~ne 2, !995, with an accompanying flood insurance rate map (FIRM), as adopted and amended from time to time, which is hereby adopted by reference and declared to be a part of this chapter. Copies of the official map are kept on file with the director of public works, the planning department and the city clerk. The boundary lines on the map shall be determined by the use of the scale appearing on the map. Where there is a conflict between the boundary lines illustrated on the map and actual field conditions, the dispute shall be settled according to section 17.56.190. Section 2. A copy of the flood insurance study and FIRM map dated October 4, 2002, that is adopted by this ordinance and incorporated into the Louisville Municipal Code shall be filed with the permanent ordinances of the City. Section 3. All other ordinances or portions thereof inconsistent or in conflict with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. Section 4. The repeal or modification of any provision of the Municipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the
