<br />RESOLUTION NO. 33 <br />SERIES 2009 <br /> <br />A RESOLUTION ORDINANCE NO. 1534, SECTION 3.20.412 ELECTRONIC <br />DATABASE; RETAILER HELD HARMLESS <br /> <br />WHEREAS, the City of Louisville is a home-rule municipality; and <br /> <br />WHEREAS, there has been evidence through performance of City of Louisville <br />audits and periodic review of provider databases that database providers certified by the <br />State of Colorado, Department of Revenue pursuant to C.R.S. S 39.26.105.3 have not met <br />the criteria specified in Section B; and <br /> <br />WHEREAS, Section 3.20A12.D and Section 3.20AOO.B of the Louisville <br />Municipal Code provides for the suspension by the finance director, for a specified period <br />of time, of the hold harmless status for taxpayers which rely on the use of an electronic <br />database to determine the taxing jurisdiction of a transaction <br /> <br />The Finance Director of the City of Louisville pursuant to Section 3.20A12.D and <br />Section 3.20AOO.B: <br /> <br />1. Suspends Section 3.20.412 of the Louisville Municipal Code. <br /> <br />2. The period of suspension shall be for 24 months or until the City determines, at its <br />own discretion, to develop and utilize its own address database, or that there is <br />sustained compliance by the database providers. <br /> <br /> <br />Cha 1 s Sisk, Mayor <br />City of Louisville, Colorado <br />
