Boulder County Clerk, CO ORD R 21.00 <br />ORDINANCE NO. 1389 <br />SERIES 2002 <br /> <br />2378875 <br /> <br />Page: 1 of 4 <br />01/02/2003 08:21R <br /> D 0.00 <br /> <br />AN ORDINANCE AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE <br />ACQUISITION OF THREE PARCELS OF VACANT REAL ESTATE FOR PARK <br />PURPOSES <br /> <br /> WHEREAS, the City of Louisville intends to enter into Purchase Contracts with Marjorie <br />Nell Pickett, Dorothy B. Pickett, and Harold Reginald Smethills, Jr. (as personal representative) for <br />the acquisition, for park purposes, of approximately 3.323 acres of property owned by such persons <br />(the "Property"); and <br /> <br /> WHEREAS, the Property consists 'of three parcels that lie within unincorporated Boulder <br />County, in the Southwest One-Quarter of Section 8, Township 1 South, Range 69 West of the 6th <br />P.M, adjacent to and north of Spruce Street between the eastern and western ends of Walnut Street, <br />and in the vicinity of the Treehaven, McKinley Park and Louisville Heights subdivisions; and <br /> <br /> WHEREAS, Louisville shall pay the owners of the Property a total of two hundred <br />seventy-six thousand six hundred and eighty-three dollars ($276,683.00), for the Property, to <br />allocated and paid in separate closing as follows: <br /> <br />Owner Portion of Property Purchase Price <br /> <br />Marjorie Nell Pickett <br />Dorothy B. Pickett <br />Harold Reginald Smethills, Jr., <br /> <br />0.8299 acres <br />0.833 acres <br />1.66 acres <br /> <br />$ 69,050.00 <br />$ 69,333.OO <br />$138,300.00; and <br /> <br /> WHEREAS, the City Cotmcil by this ordinance desires to identify the sources of funding <br />for such purchase and otherwise comply with Section 31-25-202, Colorado Revised Statutes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the City Conservation Trust Fund - Land Acquisition shall be used <br />to pay the amount of two hundred seventy-six thousand six hundred and eighty-three dollars <br />($276,683.00) for the Property, which Property is depicted on Exhibit A and further described in the <br />Purchase Agreement therefor. Said amount may be paid in separate closings for the parcels <br />constituting the Property, according to the allocation set forth above. <br /> <br /> ~. City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Purchase Contracts and to any necessary budgetary transfers or <br /> <br /> <br />
