RESOLUTION NO. 48 <br /> SERIES 2000 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL PUD DEVELOPMENT PLAN FOR 917 FRONT STREET <br />AND 834 FRONT STREET AND <br /> AN AMENDED FINAL PUD DEVELOPMENT PLAN <br /> FOR 901/909 FRONT STREET <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan and Amended Final PUD Development Plan for 917, <br />834 and 901/909 (Amendment) Front Street; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plans and Amended <br />Final PUD Development Plans have been reviewed by City Staff and the Planning Commission <br />and found, with conditions, to be in compliance with the Louisville zoning ordinances, <br />subdivision regulations, the Downtown Design Handbook, the Downtown Louisville Framework <br />Plan, related policies and previous approvals; and <br /> <br /> WHEREAS, after a duly noticed public heating concerning said Final PUD <br />Development Plan, the Planning Commission recommended approval to the City Council, with <br />conditions; and <br /> <br /> WHEREAS, the applicant has submitted revised plans in substantial compliance with the <br />recommendations of the Planning Commission and City Council finds that said Final PUD <br />Development Plan should be approved, with the following conditions: <br /> <br />That it be noted on the PUD that the elevated deck adjacent to the Front Street sidewalk shall <br />be faced with stone to match the building. <br /> <br />That the applicant shall provide prior to recording additional title information establishing <br />the ownership of the 834 Front Street property, including the area that appears to extend into <br />the RR right of way, and that the applicant shall provide a copy of the easement that crosses <br />this property, in order to determine if the proposal is consistent with the easement deed. <br />Should ownership or the terms of the easement preclude the current design, revisions would <br />be subject to further review by the City, including a possible PUD amendment. <br /> <br />That the applicant shall provide evidence that the RR right of way adjacent to the 834 Front <br />Street parking lot is available for public use, and if not, that access to the RR right of way <br />shall be appropriately restricted. <br /> <br />That the plant materials proposed along Front Street for the 834 Front Street parking lot <br />shall be subject to further Staff review and approval prior to recording of the final PUD. <br /> <br /> <br />
