RESOLUTION NO. 38 <br />SERIES 2000 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL PUD DEVELOPMENT PLAN <br /> FOR LOT 7, BLOCK 2, <br />COLORADO TECHNOLOGICAL CENTER FILING ONE <br />(McCOY SALES INCORPORATED). <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for Lot 7, Block 2, Colorado Technological <br />Center Filing One; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been <br />reviewed by City Staff and the Planning Commission and found, with conditions, to be in <br />compliance with the Louisville zoning ordinances, subdivision regulations, the Industrial <br />Development Design Standards & Guidelines (IDDSG), related policies and previous <br />approvals; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said Final PUD <br />Development Plan, the Planning Commission recommended approval to the City Council, with <br />conditions; and <br /> <br /> WHEREAS, the applicant has submitted plans in substantial compliance with the <br />recommendations of the Planning'Commission and City Council finds that said Final PUD <br />Development Plan should be approved, with the following conditions: <br /> <br />1. That corrugated metal pipe (CMP) is not permitted, with reinforced concrete pipe (RCP) to <br /> be used in its place. <br /> <br />A detail of the retaining wall is required. Materials shall be noted and the overall design <br />of the wall must appropriately relate to the site context. The retaining walls shown on the <br />plans shall be consistent with that indicated on the grading plan. Final retaining wall <br />design approval is delegated to Staff, consistent with the aforementioned stipulations. <br /> <br />That the following note shall be added to PUD plans: "The City shall not be responsible <br />for damage to, maintenance of, or repair of any private improvements affected by City <br />activities related to the public storm sewer and storm sewer easement (which, shall be <br />dedicated by separate instrument) traversing the southerly portion of the site." <br /> <br /> NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a Final PUD Development Plan for Lot 7, Block 2, <br />Colorado Technological Center Filing One, subject to the above conditions. <br /> <br /> <br />
