RESOLUTION NO. 26 <br /> SERIES 2000 <br /> A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL <br /> VACANT REAL ESTATE, WATER RIGHTS AND CONSERVATION EASEMENT <br /> WHEREAS, the City of Louisville and County of Boulder desire to purchase for open <br /> space, conservation, and right-of-way purposes title to and a conservation easement in certain <br /> parcels of real estate totaling approximately 80 acres and located east of and adjacent to the <br /> intersection of Dillon Road and South 88th Street, together with certain water rights (the <br /> "Property");and <br /> WHEREAS, the owner of the Property,Bowes Properties Limited Partnership,has stated <br /> its desire to sell the Property to the City and County upon the terms and conditions of a mutually- <br /> agreeable purchase contract. <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> 1. The proposed Bowes Purchase Agreement, Division of Land contract ("Purchase <br /> Contract") among the City of Louisville, County of Boulder and Bowes Properties Limited <br /> Partnership regarding the Property is hereby approved in essentially the same form as the copy <br /> of such Purchase Contract accompanying this Resolution. <br /> 2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor <br /> is hereby granted the authority to negotiate and approve such revisions to said Purchase Contract <br /> as the Mayor determines are necessary or desirable for the protection of the City, so long as the <br /> essential terms and conditions of the Purchase Contract are not altered. <br /> 3. The Mayor, City Administrator and City Staff are further authorized to do all <br /> things necessary on behalf of the City to perform the obligations of the City under the Purchase <br /> Contract, and to execute and deliver any and all documents necessary to effect the purchase of <br /> the Property under the terms and conditions of the Purchase Contract. <br /> PASSED AND ADOPTED this Tel day of Ar / , 2000. <br /> ..
