RESOLUTION NO. 40 <br />SERIES 2002 <br /> <br />A RESOLUTION APPROVING AN AMENDED FINAL PUD DEVELOPMENT PLAN <br />TO AUTHORIZE MCDONALD'S TO CONSTRUCT A "SIDE-BY-SIDE" (SECOND) <br />DRIVE-THRU MENU BOARD AND DRIVE-THRU LANE ON LOT 4, CENTENNIAL <br /> VALLEY PARCEL O, AT THE EXISTING MCDONALD'S RESTAURANT <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council an application to <br />review a PUD amendment to allow for the construction of a "side-by-side" (second) drive-thru <br />menu board and drive-thru lane on Lot 4, Centennial Valley Parcel O, McDonald's, 939 Dillon <br />Road, Louisville; and <br /> <br /> WHEREAS, all materials related to the amended final PUD development plan have been <br />reviewed by City Staff and the Planning Commission and found, with two conditions that have <br />been met in the final plans submitted, to comply with the applicable provisions of the Louisville <br />zoning regulations and to substantially comply with the Commercial Development Design <br />Standards; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said amended final PUD <br />development plan on 12 November, 2002, where evidence and testimony were entered into the <br />public record, including the Staff Report dated 12 November, 2002, the Planning Commission <br />recommended approval to the City Council with two conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that the Planning <br />Commission recommended conditions have been addressed in the plans and further finds that said <br />Amendment to a Final PUD Development Plan should be approved, with the following conditions: <br /> <br />The property owner shall be responsible for maintaining all landscaping in a <br />living and healthy condition, and a note to this effect shall be added to the Final <br />PUD. The properly owner shall replace all dead and dying landscape materials <br />at a time recommended by the City. <br /> <br />.' <br /> <br />The PUD landscape plan shall be modified to reflect the utilization of an <br />approved drought tolerant seed mix for the newly created landscape areas, if <br />practical as determined by staff. <br /> <br /> NOW THEREFORE, BE IT RESOLVED that the City of Louisville City Council, does <br />hereby approve the PUD amendment allowing for the construction of a "side-by-side" (second) <br />drive-thru menu board and drive-thru lane on Lot 4, Centennial Valley Parcel O, McDonald's, <br />939 Dillon Road, Louisville. <br /> <br />PASSED AND ADOPTED this 19~ day of November, 2002. <br /> <br /> <br />
