RESOLUTION NO. 4 <br />SERIES 2003 <br /> <br />A RESOLUTION APPROVING A TRANSFER AND DEVELOPMENT AGREEMENT <br /> WITH THE LOUISVILLE HOUSING AUTHORITY <br /> <br /> WHEREAS, the City of Louisville is the owner of a parcel of land of approximately 0.58 <br />acres located at 520 South Boulder Road and legally described on Exhibit A to the Agreement <br />accompanying this Resolution (the "Property"); and <br /> <br /> WHEREAS, pursuant Ordinance No. 1343, Series 2000, the Property was acquired for a <br />future site for the Louisville Housing Authority; and <br /> <br /> WHEREAS, pursuant to its home rule authority and state law, including but not limited to <br />C.R.S. §29-4-106, the City may acquire real property for any housing project of the City or a <br />housing authority, and may convey title and deliver possession of such property to such an <br />authority; and <br /> <br /> WHEREAS, an Agreement has been proposed regarding the transfer of such Property to <br />the Louisville Housing Authority the development of such Property as an Authority affordable <br />housing project consisting of up to four dwelling units. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Transfer and Development Agreement between the City of Louisville <br />and the Louisville Housing Authority regarding the Property is hereby approved in essentially the <br />same form as the copy of such Agreement accompanying this Resolution. <br /> <br /> 2. The Mayor is authorized to execute the Transfer and Development Agreement, <br />except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said <br />Agreement as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Agreement are not altered. <br /> <br /> 3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Agreement, and to <br />execute and deliver any and all documents necessary to effect the transfer of the Property under the <br />terms and conditions of the Agreement. <br /> <br />PASSED AND ADOPTED this 18th day of March, 2003. <br /> <br />Tom Davidson, Mayor <br /> <br /> <br />
