RESOLUTION NO. 6 <br />SERIES 2025 <br />A RESOLUTION APPROVING A STRUCTURE LEASE AGREEMENT FOR <br />WIRELESS EQUIPMENT AT THE LOUISVILLE RECREATION AND SENIOR <br />CENTER <br />WHEREAS, pursuant to Section 3.04.130(B) of the Louisville Municipal Code, any <br />lease of City property for a term beyond more than one fiscal year must be approved by the <br />City Council by ordinance or resolution, as the City Council shall determine; and <br />WHEREAS, there has been prepared a Structure Lease Agreement between the <br />City and New Cingular Wireless PCS, LLC for the lease of a portion of the roof and ground <br />space at the Louisville Recreation and Senior Center for New Cingular's wireless equipment; <br />and <br />WHEREAS, the City Council by this Resolution desires to approve the Structure <br />Lease Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Structure Lease Agreement, including the Memorandum of Lease, <br />between the City of Louisville and New Cingular Wireless PCS, LLC (the "Agreement"), a <br />copy of which Agreement accompanies this Resolution, is hereby approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the <br />Agreement, and the Mayor is hereby further authorized to negotiate and approve such <br />revisions to the Agreement as the Mayor determines are necessary or desirable for the <br />protection of the City, so long as the essential terms and conditions of the Agreement are <br />not altered. <br />PASSED AND ADOPTED this 18th day of February, 2025. <br />ATTEST: <br />u �n <br />Genny Kline, Interim City Clerk <br />"frt <br />ChristoP r M.
