<br /> RESOLUTION NO. 19 <br /> SERIES 2006 <br /> A RESOLUTION APPROVING <br /> AN EXTENSION OF THE PLANNED UNIT DEVELOPMENT PLAN FOR <br /> LOTS 1 -16, COLORADO TECHNOLOGY CENTER, FILING NO.2 <br />THAT WOULD EXTEND, SUBJECT TO CONDITION, THE PUD EXPIRATION DATE. <br /> WHEREAS, there has been submitted to the Louisville City Council an application to <br />extend a previously approved PUD plan - Lots 1 - 16, Colorado Technology Center, Filing No.2 <br />Final PUD - for an additional three (3) year period, from April of 2006 to April of 2009; <br /> WHEREAS, the City Staff has reviewed the information submitted and found that in order <br />to coordinate the timing of public improvements as required by the CTC No.2 Subdivision <br />Agreement with those funded road improvements to be completed by the City, a condition of <br />approval is recommended granting a partial extension to April of2007; and <br /> WHEREAS, the City Staff and the City of Louisville Planning Commission has reviewed <br />the information submitted and found it to comply with Louisville Municipal Code - Chapter 17.28; <br />and <br /> WHEREAS, after a duly noticed public hearing before the Planning Commission on April <br />13,2006 where evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated April 13, 2006 the Planning Commission finds <br />that extending the Final PUD development plan expiration date should be approved subject to the <br />following condition: <br />"A partial extension of one year shall be granted to expire in April of 2007. The <br />applicant shall be required to submit to the City construction plans and a letter of <br />credit prior to April of 2007 for those public improvement obligations as defined in <br />the CTC Filing No.2 Subdivision Agreementfor Dillon Road and South 104!h Street. <br />Once those items have been accepted and approved by the City, an automatic <br />extension for an additional two years shall be granted for the combined total of 36 <br />months.
