RESOLUTION NO. 20 <br />SERIES 2006 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT <br />REGARDING CIMARRON DRIVE <br />WHEREAS, a section of Cimarron Drive, located south of South Boulder Road, is <br />proposed to be constructed so that the roadway's centerline aligns generally with the boundary <br />between Louisville and Lafayette, thereby causing approximately one -half of the roadway to be <br />within Louisville and the other half to be within Lafayette; and <br />WHEREAS, an intergovernmental agreement has been proposed between Louisville and <br />Lafayette to establish maintenance and other responsibilities for this section of Cimarron Drive, <br />and to address other matters between the parties; and <br />WHEREAS, the City is authorized to enter into such agreement pursuant to state law, <br />including but not limited to the C.R.S. sections 29 -1 -203; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The proposed Intergovernmental Agreement Regarding Cimarron Drive between the <br />City of Louisville and the City of Lafayette (the "Agreement is hereby approved in essentially the <br />same form as the copy of such Agreement accompanying this Resolution. <br />2. The Mayor is hereby authorized to execute the Agreement on behalf of the City <br />Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate <br />and approve such revisions to said Agreement as the Mayor determines are necessary or desirable <br />for the protection of the City, so long as the essential terms and conditions of the Agreement are not <br />altered. <br />SSED AND ADOPTED this 16 day of May, 2006. <br />31 rat <br />s 1 <br />c r <br />COL <br />Nancy Varra, C Clerk <br />Ch. s L. isk, Mayor <br />
