<br /> RESOLUTION NO. 21 <br />SERIES 2006 <br /> A RESOLUTION APPROVING AN AMENDED FINAL PLANNED UNIT <br />DEVELOPMENT (PUD) PLAN FOR LOWE'S HOME IMPROVEMENT WAREHOUSE <br />LOCATED AT 1171 DILLON ROAD, LOT 5, CENTENNIAL V ALLEY, PARCEL L, <br />FILING NO.1 <br /> WHEREAS, there has been submitted to the Louisville City Council a request for <br />approval of an amended final planned unit development (PUD) plan to add a service drive aisle <br />along the west side of the building located at 1171 Dillon Road, Lot 5, Centennial Valley, Parcel <br />L, Filing No., 1 (Lowe's Home Improvement Warehouse); and <br /> WHEREAS, all materials related to the final PUD development plan have been <br />reviewed by City Staff and the Planning Commission and found, to be in compliance with the <br />Louisville zoning ordinances, subdivision regulations, the Commercial Development Design <br />Standards and Guidelines, related policies and previous approvals; and <br /> WHEREAS, the Planning Commission held two duly noticed public hearings <br />concerning said amendment to a final PUD development plan on March 9, 2006 and April 13, <br />2006, where evidence and testimony were entered into the record, including the application <br />materials and Staff Reports dated March 9,2006 and April 13, 2006, the Planning Commission <br />recommended approval to the City Council, with six conditions; and <br /> WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and finds that as the revised PUD reflects compliance with three <br />of the six conditions of the Planning Commission the application should be approved, with <br />three conditions, as follows: <br />1. A minimum of 2 5% of the new evergreen trees shall be installed at a height of 8 feet. <br />2. No building permits shall be issued for the drive aisle and wall without verification that <br /> the balance of the site is in full compliance with the outdoor sales and storage <br /> requirements from previous approvals. <br />3. The rear service drive area shall be posted with permanent signs indicate that the area is <br /> not allowed to be used for storage of merchandise or other materials. Said signs shall be <br /> posted at 50 foot intervals and shall be reviewed and approved by staff during the <br /> building permit review process. <br />
