<br />RESOLUTION NO. 10 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE <br />TO CONSTUCT AND OPERATE A CITY <br />SKATE PARK FACILITY, OFF-STREET PARKING LOT, AND ASSOICATED <br />PEDESTRAIN BRIDGE STRUCTURE TO THE ARBORETUM <br /> <br />WHEREAS, there has been submitted to the Louisville City Council, application for <br />approval of a special review use for a skate park facility, associated off-street parking area, and <br />pedestrian bridge to the arboretum; and <br /> <br />WHEREAS, all materials related to the special review use application have been <br />reviewed by City Staff and the Planning Commission and found, with condition, to be in <br />compliance with Chapter 17 of the Louisville Municipal Code, including the special review use <br />criteria from 17.40.1 OO.A; and <br /> <br />WHEREAS, after a duly noticed public hearing concerning said special review use on <br />February 10, 2004, where evidence and testimony were entered into the public record, including <br />the Staff Report of same date, the Planning Commission recommended approval to the City <br />Council, with one (1) condition; and <br /> <br />WHEREAS, City Council has reviewed the application and the recommendation of the <br />Planning Commission and City Council finds that the application should be approved, with the <br />following condition: <br /> <br />1. The photometric plan shall be further reviewed by staff to insure that the proposed lighting <br />levels have been minimized consistent with the requirements of the facility, and the adjoining <br />neighborhoods. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a special review use for the City of Louisville Skate <br />Park, associated off-street parking lot, and pedestrian bridge to the arboretum, subject to the <br />above condition. <br /> <br /> <br />By: <br /> <br />Nancy Varra City Clerk <br />City of Louisville, Colorado <br />
