<br /> .'? <br /> 111111111111111111111111111111111111111111111111111111I 2802909 <br /> Page: 1 of 2 <br /> 09/05/2006 02:25P <br /> Boulder County Clerk, CO ORD R 11.00 D 0.00 <br /> ORDINANCE NO. 1496 <br /> SERIES 2006 <br /> AN ORDINANCE APPROVING THE VACATION OF A 40' BY 130' JOINT ACCESS <br /> EASEMENT SITUATED IN LOTS 4 AND 5 ALVENUS PARK SUBDIVISION <br /> WHEREAS, by the plat of the Alvenus Park Subdivision, recorded January 23, 1995 at <br /> Plan File P-33 F-2 #3, Reception No. 1493909, Boulder County Records, there was dedicated to the <br /> City a 40-foot by 130-foot joint access easement situated in Lots 4 and 5, Alvenus Park <br /> Subdivision; and <br /> WHEREAS, proper application has been made to the City for vacation of the joint access <br /> easement; and <br /> WHEREAS, the City Council has determined that the joint access easement for Lots 4 and <br /> 5, Alvenus Park Subdivision for which vacation has been requested is not and has not been used or <br /> required as a roadway or thoroughfare for the public; and <br /> WHEREAS, the City Council has determined that the joint access easement for Lots 4 and <br /> 5, Alvenus Park Subdivision for which vacation is requested is not and will not be needed for any <br /> public purposes; and <br /> WHEREAS, the City Council has determined that the joint access easement for Lots 4 and <br /> 5, Alvenus Park Subdivision for which vacation is requested is not being used or held for park <br /> purposes or for any other governmental purposes; and <br /> WHEREAS, the City Council desires to approve the application and vacate the City's <br /> interests in the joint access easement for Lots 4 and 5, Alvenus Park Subdivision described herein <br /> for which vacation is requested. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. The City hereby vacates that certain a 40-foot by 130-foot joint access <br /> easement situated in Lots 4 and 5, Alvenus Park Subdivision (which easement is hereafter referred <br /> to as the "Access Easement"). Title to the vacated Access Easement shall vest in the manner <br /> provided by law. <br /> Section 2. Easements for existing public utilities, if any, shall not be altered or <br /> amended by virtue of this ordinance. <br /> Section 3. The Mayor is authorized to execute such additional documents as may be <br /> necessary to evidence the vacation of Access Easement as set forth herein. <br /> 1 <br />2/1 <br />-- <br />
