RESOLUTION NO. 14 <br /> SERIES 2011 <br /> A RESOLUTION ACCEPTING THE DEDICATION OF RIGHT -OF -WAY FOR HECLA <br /> DRIVE AND DESIGNATING FOR USE FOR RIGHT -OF -WAY AND UTILITY <br /> PURPOSES PORTIONS OF CITY -OWNED OUTLOT B OF THE DAVIDSON <br /> HIGHLINE P.U.D. SUBDIVL'SION <br /> WHEREAS, the plat and planned unit development (P.U.D.) plan for the Takoda <br /> subdivision provide for and require the construction of Hecla Drive and utilities along Hecla <br /> Drive within portions of Outlot B of the Davidson Highline P.U.D. subdivision and portions of <br /> Lot 3A of the Replat of the Davidson Highline P.U.D.; and <br /> WHEREAS, RMCS, LLC is the owner of said Lot 3A and the City of Louisville is the <br /> owner of said Outlot B; and <br /> WHEREAS, in order to provide for the completion of Hecla Drive, there has been <br /> proposed a conveyance of right-of-way from RMCS, LLC to the City of Louisville consisting of <br /> that portion of Lot 3A that is described in Exhibit A; and <br /> WHEREAS, also in order to provide for the completion of Hecla Drive and utilities <br /> along Hecla Drive, it has been proposed that those portions of Outlot B that are described on <br /> Exhibits B and C be designated for use for, respectively, Hecla Drive right -of -way and utilities; <br /> and <br /> WHEREAS, the City Council by this resolution desires to formally state its acceptance <br /> of the dedication of the parcel described on Exhibit A as Hecla Drive right -of -way for public use; <br /> and <br /> WHEREAS, the City Council by this resolution further desires to designate the parcels <br /> described on Exhibits B and C for use for, respectively, Hecla Drive right -of -way and utilities; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO THAT: <br /> 1. The City Council hereby accepts the dedication of the parcel described in Exhibit A <br /> attached hereto as right -of -way for Hecla Drive, a public street. Said dedication shall be effected by <br /> conveyance of said parcel to the City by Special Warranty Deed in form acceptable to the City. <br /> Said deed shall be recorded at the expense of the grantor of said right -of -way. <br /> 2. The City Council hereby designates as right -of -way for Hecla Drive, a public street, <br /> that portion of Outlot B of the Davidson Highline P.U.D. subdivision that is described on Exhibit <br /> B attached hereto. <br /> Resolution No. 14, Series 2011 <br /> Page 1 of 2 <br />
