<br />1 \1111\ 111\1 \111\1 11\\11\1111 \\11111111 III 1111\ \111 \111 ~~~~f:~~9P <br /> <br />Boulder County Clerk, CO RESOLUTION R 11.00 0 0.00 <br /> <br />RESOLUTION NO. 22 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE AND AMENDED FINAL <br />PUD FOR A 66-UNIT RESIDENTIAL CONDOMINIUM PROJECT ON LOT 1, <br />CENTENNIAL PAVILION SUBDIVISION (CENTENNIAL PAVILION LOFTS) <br /> <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a special review use (SRU) and amended final planned unit development (PUD) <br />development plan for a 66-unit residential condominium project on Lot 1, Centennial Pavilion <br />Subdivision; and, <br /> <br />WHEREAS, all materials related to the SRU and PUD have been reviewed by City Staff <br />and the Planning Commission and have been found to comply with Chapter 17 of the LMC, <br />including the SRU criteria listed in Section 17.40.100, the Commercial Development Design <br />Standards and Guidelines and the City's 1989 Comprehensive Plan Update; and, <br /> <br />WHEREAS, after a duly noticed public hearings on February 10,2004, February 19, <br />2004, and March 9, 2004, where evidence and testimony were entered into the record, including <br />the findings in the Louisville Planning Commission Staff Report of February 10, 2004, February <br />19,2004, and March 9, 2004 the Planning Commission recommended approval to the City <br />Council, with one condition; and, <br /> <br />WHEREAS, City Council has reviE~wed the application, including the recommendation <br />of the Planning Commission and finds that the application should be approved, with the <br />following conditions: <br /> <br />1. The applicant shall pay an additional public use dedication fee to be based on the difference <br />between a 12 and 15 percent dedication requirement for this quadrant of the property. Fee <br />shall be established prior to recording of the PUDISRU plans and shall be paid prior to the <br />issuance of the first building permit for any residential units on this property. <br /> <br />2. Prior to recording of the PUD, the Owner shall enter into an agreement with the City of <br />Louisville to formalize Owner's commitment to make seven units within the development <br />affordable housing pursuant to an 80 percent or less of median income earning criteria. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a special review use and amended final PUD <br />development plan application for Centennial Pavilion Lofts on Lot 1, Centennial Pavilion <br />Subdivision, subject to the above conditions. <br /> <br />PASSED AND ADOPTED this 1st day of June 2004. <br /> <br />1 <br /> <br />LO~ 149 <br />
