ORDINANCE NO. 1596 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING SECTION 3.20.402 OF THE LOUISVILLE MUNICIPAL <br /> CODE TO PROVIDE THAT SALES AND USE TAX LICENSE FEES WILL BE <br /> ESTABLISHED BY RESOLUTION OF THE CITY COUNCIL <br /> WHEREAS, the City Council previously adopted Subsection C of Section 3.20.402 of the <br /> Louisville Municipal Code setting forth fees for sales and use tax licenses; and <br /> WHEREAS, the City Council desires to amend Subsection C of Section 3.20.402 of the <br /> Louisville Municipal Code to provide that such fees shall be as set forth by resolution of the City <br /> Council; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. Subsection C of Section 3.20.402 of the Louisville Municipal Code is hereby <br /> amended to read as follows (words to be deleted are shown in strikeout; words to be added are <br /> underlined): <br /> Sec. 3.20.402. Sales /use tax license. <br /> C. For each license issued under the provisions of this chapter, a fee of <br /> $25.00 shall be paid and shall accompany the application. An annual fee of $25.00 <br /> shall be paid for each year or fraction thereof for which such license is issued or <br /> renewed. No license shall be issued until the required fee has been paid in full. The <br /> license fee and the annual fee shall be as established by resolution of the city council. <br /> Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br /> decisions shall not affect the validity of the remaining portions of this ordinance. The City Council <br /> hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br /> that any one part be declared invalid. <br /> Section 3. The repeal or modification of any portion of the Municipal Code of the City of <br /> Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part <br /> any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such <br /> provision, and each provision shall be treated and held as still remaining in force for the purpose of <br /> sustaining any and all proper actions., suits, proceedings, and prosecutions for the enforcement of the <br /> penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order <br /> Ordinance No. 1596, Series 2011 <br /> Page 1 of 2 <br />
