<br />ORDINANCE NO. if !~ <br /> <br />AN ORDINANCE REPEALING ORDINANCE NO. 338 WHICH PROVIDED <br />FOR THE LEVYING OF A TAX ON THE BUSINESS OF SELLING <br />CIGARETTESs BOTH WHOLESALE AND RETAIL. <br /> <br />WHEREASs the Colorado State Legislature has passed an Act entitled <br />House Bill No. 1492 which provides for the state to levy a state cigarette <br />tax of 10~ per pack; and, <br />WHEREASs said Act further provides that the State shall distribute <br />to incorporated towns an amount equal to 4.6~ per packs and <br />WHEREASs as a condition to be eligible to receive said monies the <br />City must repeal its tax on the business of selling cigarettess <br /> <br />NOW THEREFOREs <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLEs COLORADO: <br /> <br />Section 1. Ordinance No. 338 Entitled "An Ordinance Pertaining <br />to a Cigarette Tax and Cigarette Stamps Used in Connection therewith; <br />Licensing the Business of Selling or Vending Cigarettes; Defining Dealers <br />in Cigarettes and Those Leasing Cigarette Vending Machines; Setting Forth <br />Applicable Tax and Fees; Prescribing Penalties for the Violation Thereof; <br />and Repealing All Ordinances or Parts of Ordinances in Conflict Herewith" <br />and all amendments thereto are hereby repealed effective July ls 1973. <br />Section 2. Emergency Clause. That whereas under the provisions <br />of said Acts House Bill No. 1492s it is necessary for Cities in order to <br />be eligible to participate in said cigarette tax funds to repeal their <br />own ordinances levying similar taxes by July ls 1973s and that whereas <br />these funds are necessary for the preservation of the public peaces health <br />and safety of the Citizens of Louisville; NOW THEREFORE this Ordinance <br />
