111111111111111111111111111111111 1111111111111111111111111 0 3 207742 03/07/2012 08:55 AM RF:$16.00 DF:$0.00 , Boulder County Clerk,CO • • ORDINANCE NO. 1608 SERIES 2011 AN ORDINANCE APPROVING THE VACATION OF AN ELEVEN FOOT (11') BY FIFTY FOOT (50') PORTION OF MAIN STREET (SOUTH SECOND STREET) RIGHT-OF-WAY LOCATED ADJACENT TO LOTS 5 AND 6, BLOCK 7 IN THE MURPHY PLACE SUBDIVISION IN THE CITY OF LOUISVILLE WHEREAS, by the plat of said Murphy Place Subdivision, recorded in 1907 as Reception No. 57381, Plat Book 3, Page 28, Boulder County Records, there was dedicated for public use a right-of-way 60 feet wide and 50 feet in length located between Lots 14 and 15, Block 8 and Lots 5 and 6, Block 7,Murphy Place Subdivision; and WHEREAS, proper application has been made to the City for vacation of the westernmost eleven feet (11') of said right-of-way, which eleven foot (11') by fifty foot (50') area is hereafter referred to as"the Right-of-Way"; and WHEREAS, the City Council finds and determines that the Right-of-Way for which vacation is requested is not and will not be needed for any public purpose; and • WHEREAS, the City Council finds and determines that the Right-of-Way for which vacation is requested is not being used or held for park purposes or for any other governmental purpose; and WHEREAS, the City Council has therefore determined that it is appropriate to vacate the City's interests in the easement described herein. NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. The City hereby vacates the westernmost eleven feet (11') of that certain portion of Main Street(South Second Street) right-of-way located between Lots 14 and 15, Block 8, and Lots 5 and 6,Block 7, Murphy Place Subdivision, which right-of-way was dedicated by the plat of said Murphy Place Subdivision, recorded in 1907 as Reception No. 57381, Plat Book 3, Page 28, Boulder County Records, and which eleven foot by fifty foot (11' x 50') area of right-of-way vacated by this ordinance is depicted on Exhibit A attached hereto and hereafter referred to as "the Right-of-Way." Title to the vacated Right-of-Way shall vest in the owner of the adjoining property in the manner provided by law. Section 2. The Mayor and City Staff are hereby authorized to execute such additional documents as may be necessary to evidence the vacation of the Right-of-Way herein vacated, including without limitation any quit claim deed. • Ordinance No. 1608, Series 2011 Page 1 of 2
