111111111111111 11111111111111111 I 1111111111 11 II III 111 03207743 207743 03/07/2012 08:55 AM RF:$21.00 DF:$0.00 Boulder County Clerk,CO • ORDINANCE NO. 1610 SERIES 2011 AN ORDINANCE APPROVING THE VACATION OF A TEN (10) FOOT BY SIXTY TWO AND ONE HALF (62.5) FOOT PORTION OF AN ALLEY LOCATED ADJACENT TO LOTS 1, 2, 3, AND 6, BLOCK 8 IN THE JEFFERSON PLACE SUBDIVISION IN THE CITY OF LOUISVILLE WHEREAS, by the plat of Jefferson Place Subdivision, recorded in the Office of the Boulder County Clerk and Recorder on December 27, 1880 in Plat Book 2 at Page 9, there was dedicated for public use an alley 10 feet wide and 125 feet in length located between Lots 1-5 and Lot 6,Block 8,Jefferson Place Subdivision; and WHEREAS, the western half of said alley has been vacated by City of Louisville Ordinance Number 1041; and WHEREAS,proper application has been made to the City for vacation of the eastern half of said alley, which ten (10) foot by sixty two and a half(62.5) foot area is hereafter referred to as the "Alley Right-of-Way"; and WHEREAS, the City Council finds and determines that the Alley Right-of-Way for which • vacation is requested is not and will not be needed for any public purpose; and WHEREAS, the City Council finds and determines that the Alley Right-of-Way for which vacation is requested is not being used or held for roadway or utility purposes or for any other governmental purpose; and WHEREAS, the City Council has therefore determined that it is appropriate to vacate the City's interests in the Alley Right-of-Way described herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. The City hereby vacates the eastern half of that certain 10-foot wide by 125- foot long alley right-of-way running east-west and lying between Lots 1-5 and Lot 6, Block 8, Jefferson Place Subdivision, City of Louisville, Boulder County, Colorado which 10-foot by 62.5- foot area of alley vacated by this ordinance is depicted on Exhibit A attached hereto and hereafter referred to as "the Alley Right-of-Way." Title to the vacated Alley Right-of-Way shall vest in the owner of the adjoining property in the manner provided by law. Section 2. The Mayor and City Clerk are hereby authorized to execute such additional documents as may be necessary to evidence the vacation of the Right-of-Way herein vacated, including without limitation any quit claim deed. • Ordinance No. 1610, Series 2011 • Page 1of2 3h
