ORDINANCE NO. 1615 <br /> SERIES 2012 <br /> AN ORDINANCE AMENDING CHAPTER 17 OF THE LOUISVILLE MUNICIPAL <br /> CODE TO ALLOW THE LIMITED WHOLESALING OF PRODUCTS WITHIN THE <br /> COMMERCIAL BUSINESS (C-B), COMMERCIAL COMMUNITY (C-C), <br /> INDUSTRIAL (I), AND THE PLANNED COMMUNITY—COMMERCIAL (P-C) ZONE <br /> DISTRICTS AND THE COMMUNITY COMMERCIAL (CC) ZONE DISTRICT <br /> WITHIN THE HIGHWAY 42 REVITALIZATION AREA <br /> WHEREAS, the City of Louisville is a home rule municipal corporation organized under <br /> and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br /> and <br /> WHEREAS, Section 17.12.030 of the Louisville Municipal Code (LMC) limits <br /> wholesaling services to the Commercial Business (C-B) zone district as a use by right and the <br /> Industrial (I) zone district as a special review use; and <br /> WHEREAS, Section 17.14.050 of the LMC limits wholesaling activities in the <br /> Commercial Community (CC) zone district within the Highway 42 Revitalization Area (the <br /> Mixed Use Zone District Overlay) to those involving food products; and <br /> WHEREAS, Section 17.72.090 does not allow wholesaling activities in areas zoned <br /> Planned Community—Commercial (P-C); and <br /> WHEREAS, the City desires to allow limited wholesaling activities as an accessory use <br /> in the Commercial Community (C-C), C-B, I, and P-C zone districts and the CC zone district <br /> within the Highway 42 Revitalization Area; and <br /> WHEREAS, permitting limited wholesaling activities in these districts will contribute to <br /> the vitality of these commercial districts by allowing new businesses and business models to <br /> locate there; and <br /> WHEREAS, the City desires to maintain these zones' focus on retail activities and <br /> ensure that wholesaling activities remain as accessory uses; and <br /> WHEREAS, the City has determined it is appropriate to permit limited wholesaling <br /> activities as a use by right in the C-B zone district and the CC zone district within the Highway <br /> 42 Revitalization Area; and <br /> WHEREAS, the City has determined that permitting limited wholesaling activities as a <br /> special review use in the C-C, I, and the P-C zone districts will allow the City to evaluate each <br /> proposed use and ensure the use is compatible with the neighborhood; and <br /> WHEREAS, the City has determined that the administrative special review use <br /> procedure is not appropriate for this new and untested use; and <br /> Ordinance No. 1615, Series 2012 <br /> Page 1 of 4 <br />
