3- , #~1574814 01/05/96 03:40 PM REAL ESTATE REr.ORDS FL099 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER ORDINANCE NO. 1186 SERIES 1995 AN ORDINANCE AUTHORIZING THE CONVEYANCE BY QUIT CLAIM DEED OF ANY TITLE AND INTEREST OF THE CITY OF LOUISVILLE IN A PARCEL OF REAL PROPERTY LOCATED IN CENTENNIAL HEIGHTS WEST SUBDIVISION WHEREAS, during the development and construction of the Centennial Heights West, a subdivision of the City of Louisville, a property line adjustment between Lots 34 and 35 thereof was necessary in order to provide and maintain the required sideyard setbacks on Lot 34; and WHEREAS, the City's annual inventory of City assets revealed that a small portion of Lot 35 adjoining Lot 34, which portion consisted of 52 square feet and was sufficient to correct the sideyard setback deficiency if made a part of Lot 34, had been conveyed to the City by Sheffield Homes, the subdivider of Centennial Heights West, by special warranty deed recorded on January 18, 1994 at Reception No. 01384890 in the office of the Boulder County Clerk and Recorder; and WHEREAS, the conveyance of a portion of Lot 34 to the City was inadvertent, the property is not needed for any public use, the City has no need for the property for park purposes or any other governmental purpose, nor a desire to retain title; and WHEREAS, the City wishes to dispose of the property by quit claim deed to the owners of Lot 34; and WHEREAS, this ordinance and the conveyance authorized hereby are made pursuant to the provisions of C.R.S. ~31-15-7l3. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Any title and interest of the City of Louisville in the following described portion of Lot 35, Centennial Heights West , City of Louisville, County of Boulder, State of Colorado, shall be transferred by quit claim deed to the current owners of Lot 34, Centennial Heights West, City of Louisville, County of Boulder, State of Colorado. 1 /' i l
