<br />ORDINANCE NO. 1184 <br />SERIES 1995 <br /> <br />AN ORDINANCE CONSENTING TO THE CITY OF LOUISVILLE'S <br />INCLUSION IN THE MUNICIPAL SUBDISTRICT OF THE NORTHERN <br />COLORADO WATER CONSERVANCY DISTRICT. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Petition for Inclusion. The City Council of <br />the City of Louisville (the "City") hereby consents to the filing <br />of petitions with the District Court of Weld County pursuant to <br />C.R.S. S37-45-136 for the inclusion of the City of Louisville <br />within the Municipal Subdistrict of the Northern Colorado Water <br />Conservancy District ("Subdistrict"), and the Mayor, as the chief <br />executive officer of the City, is authorized to consent to the <br />inclusion of the City within said Municipal Subdistrict and to <br />request the Subdistrict's consent to said inclusion. <br /> <br />Section 2. Levies and Assessments. Upon inclusion into <br />the Subdistrict, said property shall be subject to the same mill <br />levies and special assessments as are levied or will be levied on <br />other similar situated property in the Subdistrict. <br /> <br />Section 3. Consent to be Bound by State Law. <br />hereby consents to be bound by the provisions of <br />Conservancy Act, C.R.S. ~37-45-101 et ~ <br /> <br />The City <br />the Water <br /> <br />Section 4. The City Council herewith finds, determines, <br />and declares that this ordinance is necessary for the preservation <br />of the public health and safety. <br /> <br />Section 5. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each <br />part hereof irrespective of the fact that anyone part be declared <br />invalid. <br /> <br />Section 6. All other ordinances or portions thereof <br />inconsistent or conflicting with this ordinance or any portion <br />hereof are hereby repealed to the extent of such inconsistency or <br />conflict. <br /> <br />1 <br />
