ORDINANCE NO. 1184 SERIES 1995 AN ORDINANCE CONSENTING TO THE CITY OF LOUISVILLE'S INCLUSION IN THE MUNICIPAL SUBDISTRICT OF THE NORTHERN COLORADO WATER CONSERVANCY DISTRICT. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Petition for Inclusion. The City Council of the City of Louisville (the "City") hereby consents to the filing of petitions with the District Court of Weld County pursuant to C.R.S. S37-45-136 for the inclusion of the City of Louisville within the Municipal Subdistrict of the Northern Colorado Water Conservancy District ("Subdistrict"), and the Mayor, as the chief executive officer of the City, is authorized to consent to the inclusion of the City within said Municipal Subdistrict and to request the Subdistrict's consent to said inclusion. Section 2. Levies and Assessments. Upon inclusion into the Subdistrict, said property shall be subject to the same mill levies and special assessments as are levied or will be levied on other similar situated property in the Subdistrict. Section 3. Consent to be Bound by State Law. hereby consents to be bound by the provisions of Conservancy Act, C.R.S. ~37-45-101 et ~ The City the Water Section 4. The City Council herewith finds, determines, and declares that this ordinance is necessary for the preservation of the public health and safety. Section 5. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that anyone part be declared invalid. Section 6. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. 1
