ORDINANCE NO. 1620 <br /> SERIES 2012 <br /> AN ORDINANCE ZONING AS RESIDENTIAL LOW-DENSITY (RL) <br /> CERTAIN PROPERTY ANNEXED INTO THE CITY OF LOUISVILLE <br /> AND KNOWN AS THE KLINE PROPERTY <br /> WHEREAS, pursuant to Ordinance No.1619, Series 2012, the City annexed certain <br /> unincorporated property, referred to as Kline Property and described in Exhibit A attached hereto <br /> (the"Kline Property"); and <br /> WHEREAS, the City Council must provide for the initial zoning of the Kline Property; <br /> and <br /> WHEREAS, the landowners have requested a Residential Low-Density (RL) zoning <br /> classification for the Kline Property, in accordance with Title 17 of the Louisville Municipal <br /> Code (LMC); and <br /> WHEREAS, the City Council has provided notice of its public hearing on said zoning <br /> request in the manner required by law; and <br /> WHEREAS, the Kline Property is subject to the 2009 Louisville Comprehensive Plan; and <br /> WHEREAS, the Plan designates the area around and including the Kline Property for low- <br /> and medium-density residential development; and <br /> WHEREAS, Section 17.12.010.B of the LMC states: "after June 2, 1994... no land shall be <br /> zoned or rezoned as... a residential low-density(RL) zone district;" and <br /> WHEREAS, notwithstanding said provision of the LMC, the City Council finds that the <br /> Residential Low-Density (RL) zone district is most appropriate for the Kline Property, given its <br /> size, location, development, enclave status, and the surrounding zoning; and <br /> WHEREAS, the City Council further finds that a City zoning classification of Residential <br /> Low-Density (RL) is consistent with the purposes and intent of the Comprehensive Plan and <br /> appropriate under the Plan and the City's zoning regulations; and <br /> WHEREAS, the City Council therefore intends by this ordinance to override Section <br /> 17.12.010.B of the LMC to zone the Kline Property Residential Low-Density(RL); and <br /> WHEREAS, after a duly noticed public hearing held July 12, 2012, where evidence and <br /> testimony were entered into the record, including the findings in the Louisville Planning <br /> Ordinance 1620,Series 2012 <br /> Page 1 of4 <br />
