RESOLUTION NO. 1 <br /> SERIES 2013 <br /> A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT FOR CITY <br /> MEMBERSHIP IN THE EAGLE-NET ALLIANCE <br /> WHEREAS, pursuant to Colorado law, including without limitation C.R.S. § 29-1- <br /> 203, there has been heretofore created an intergovernmental agency known as The <br /> EAGLE-Net Alliance; and <br /> WHEREAS, the purposes of the EAGLE-Net Alliance include, without limitation, <br /> creating a mechanism to deploy and offer a variety of broadband connectivity and <br /> affordable services to schools, libraries, governments and other community anchors; and <br /> WHEREAS, the purposes of the EAGLE-Net Alliance further include, without <br /> limitation, creating a structure to coordinate and cooperate in the administration, <br /> monitoring and deployment of broadband services to schools, libraries, governments and <br /> other community anchors, and to explore new means of achieving common objectives <br /> pertaining to broadband services within Colorado, so as to increase broadband <br /> opportunities for Colorado schools, libraries, governments and other community anchors; <br /> and <br /> WHEREAS, the City desires to become a member of the EAGLE-Net Alliance in <br /> order to receive broadband services and otherwise participate in the Alliance; and <br /> WHEREAS, in order to become a member of the EAGLE-Net Alliance, the City <br /> must enter into the Intergovernmental Agreement goveming membership and participation <br /> therein; and <br /> WHEREAS, the City is authorized to enter into the Intergovernmental Agreement <br /> pursuant to its charter and state law, including but not limited to C.R.S. § 29-1-203, and <br /> the City Council by this Resolution desires to approve said Agreement and authorize its <br /> execution; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> 1. The Intergovernmental Agreement for City membership in The EAGLE-Net <br /> Alliance (the "IGA"), is hereby approved in essentially the same form as the copy of such <br /> IGA accompanying this Resolution. <br /> 2. The Mayor is authorized to execute the IGA on behalf of the City, except that <br /> the Mayor is hereby further granted authority to negotiate and approve such revisions to <br /> said IGA as the Mayor determines are necessary or desirable for the protection of the City, <br /> so long as the essential terms and conditions of the IGA are not altered. <br /> Resolution No.1,Series 2013 <br /> Page 1 of 2 <br />
