. <br /> • AGREEMENT <br /> This Agreement is made and entered into this ,67-fh. day of a/PAL( , 19 1w <br /> by and between the CITY OF LOUISVILLE, a Colorado municipal corporation <br /> ("Louisville")and CITY OF LAFAYE'1'1'E, Colorado, a municipal corporation("Lafayette") <br /> (individually "Party" and collectively the "Parties"). <br /> RECITALS <br /> WHEREAS, Louisville has existing water treatment facilities which currently have <br /> excess capacity to treat surface water and an existing water transmission lines near <br /> Lafayette's existing water transmission lines; and <br /> WHEREAS, Louisville has determined that it would be beneficial to its taxpayers <br /> and inhabitants to use a portion of its excess water treatment capacity to treat surface water <br /> provided by Lafayette under the terms and conditions of this Agreement provided that said <br /> use does not jeopardize Louisville's ability to provide treated water to its existing and future <br /> customers; and <br /> WHEREAS, Lafayette desires to utilize Louisville's Treatment Facilities to meet <br /> peak demands in its service area; and <br /> WHEREAS, Louisville is willing to allow Lafayette to connect to Louisville's water <br /> system for a period of time; and <br /> WHEREAS, Lafayette shall make payments to Louisville for use of its excess water <br /> treatment capacity; and <br /> WHEREAS, Lafayette has the surface water which is deliverable to Louisville's <br /> water treatment facilities available for treatment by Louisville; <br /> NOW, THEREFORE, in consideration of the mutual covenants and agreements set <br /> forth herein, the Parties agree as follows: <br /> 1 <br />
