<br />101290890 05/07/93 02:18 PM REAL ESTATE RECORDS <br />F1820 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER <br /> <br />2,./ <br /> <br />ORDINANCE NO. 1096 <br />SERIES 1993 <br /> <br />AN ORDINANCE AMENDING CHAPTER 17.48 OF THE LOUISVILLE <br />MUNICIPAL CODE TO PROVIDE FOR SIX MEMBERS ON THE BOARD OF <br />ADJUSTMENT, ESTABLISHING A RESIDENCY REQUIREMENT AND <br />ELIMINATING THE POSITION OF ASSOCIATE MEMBER. <br /> <br />JS <br /> <br />WHEREAS, the current Board of Adjustment consists of five <br />appointed members and two appointed alternate members; and <br /> <br />WHEREAS, the C.R.S. 931-23-307 authorizes the City Council to <br />establish a different number of members by ordinance; and <br /> <br />WHEREAS, the City desires to provide for a Board of Adjustment <br />consisting of six members and eliminate the positions of designated <br />alternate member. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 17.48.020 of the Louisville Municipal <br />Code is hereby amended to read as follows (words to be deleted are <br />stricken through; words to be added appear in capital letters). <br /> <br />17.48.020 Members <br /> <br />Appointment <br /> <br />The'eboard of adjustment shall consist of #ve SIX <br />members who shall be appointed by the city council. None <br />of the members may be current members of the city <br />planning commission. MEMBERS SHALL BE RESIDENTS OF THE <br />CITY AT THE TIME OF THEIR APPOINTMENT AND AT ALL TIMES <br />WHILE SERVING ON THE BOARD. <br /> <br />Section 2. Section 17.48.030. B of the Louisville Municipal <br />Code is hereby repealed in its entirety. <br /> <br />... <br /> <br />Section 3. ' The initial term of the member appointed to the <br />sixth position on the Board of Adjustment pursuant to Section 1 of <br />this Ordinance shall begin and end on such dates as the Council may <br />prescribe, but shall not exceed three years and the terms of <br />succeeding members for such position shall be for a period of three <br />years. <br /> <br />Section 4. If any article, section, paragraph, sentence, <br />clause or phrase of this ordinance is held to be unconstitutional <br />or invalid for any reason, such decision shall not affect the <br />validity or constitutionality of the remaining portions of this <br />ordinance.
