1111iiN11Nimnf11w oN 111.1111101 IHhl1 03355627 Page: 1 of 2 DF: $0.00 ORDINANCE NO. 1646 SERIES 2013 AN ORDINANCE APPROVING THE VACATION OF AN EXISTING 30 FOOT ACCESS AND UTILITY EASEMENT LOCATED WITHIN LOT 11 AND LOT 15, COLORADO TECHNOLOGICAL CENTER, FILING NO. 2 WITHIN THE CITY OF LOUISVILLE WHEREAS, by the Colorado Technological Center Filing No. 2 Plat recorded in the Office of the Boulder County Clerk and Recorder on November 13, 2003 at Plan File P-59, F-3, #30, 31, Reception # 2527192, there was dedicated a 30 foot access and utility easement over Lot 11 and Lot 15, Colorado Technological Center Filing No. 2, in the City of Louisville, County of Boulder, State of Colorado ("Lot 11 and Lot 15"); and WHEREAS, the purpose of such easement was to provide access for the City of Louisville and other utility providers to maintain utilities within said easement; and WHEREAS, the City of Louisville Public Works Department and the private utility providers which have an interest in the easement have determined the 30 foot access and utility easement dedicated under the Colorado Technological Center Filing No. 2 Subdivision Plat is no longer necessary for access or maintenance of utilities; and WHEREAS, the City Council finds and determines that the 30 foot access and utility easement for which vacation is requested is no longer used, held or needed for any utility, park, public or governmental purpose; and WHEREAS, the City Council desires to approve the application and vacate any interest of the City in the 30 foot access and utility easement over Lot 11 and Lot 15 for which vacation is requested; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City hereby vacates the City's interests in that certain 30 foot access and utility easement over Lot 11 and Lot 15, Colorado Technological Center Filing No. 2, dedicated to the City by said Colorado Technological Center Filing No. 2 Subdivision Plat recorded in the Office of the Boulder County Clerk and Recorder on November 13, 2003 at Plan File P-59, F-3, #30, 31, Reception # 2527192, and which vacated easement is depicted in Exhibit A, attached hereto and incorporated herein by reference. Title to the vacated easement shall vest in the manner provided by law. Section 2. No other easements for public utilities shall be deemed altered or amended by virtue of this ordinance. Section 3. The Mayor, City Manager and City Clerk are hereby authorized to execute such additional documents as may be necessary or appropriate to evidence the vacation of the 30 Ordinance No. 1646, Series 2013 Page 1 of 2
