<br />~01242694 11/24/92 03:20 PM REAL ESTATE RECORDS <br />F1779 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER <br />ORDINANCE NO. 1085 <br />SERIES 1992 <br /> <br />1-1 <br /> <br />AN ORDINANCE AMENDING TITLE 6 OF THE LOUISVILLE MUNICIPAL CODE <br />RELATING TO ANIMALS. <br /> <br />WHEREAS, the City Council of the City of Louisville finds that <br />it is in the best interests and promotes the health, safety, and <br />welfare of the citizens of Louisville to provide for more effective <br />control over certain animals within the City. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Title 6 of the Louisville Municipal Code is <br />amended by the addition of a new Chapter 6.02, to read as follows: <br /> <br />r <br /> <br />t.-; <br /> <br />Chapter 6.02 <br /> <br />DEFINITIONS <br /> <br />6.02.010 Definitions. <br /> <br />For the purposes of this title, unless the context <br />clearly indicates otherwise, the following words and <br />terms shall have the following meanings: <br /> <br />A. Abandon. Leaving of an animal by its owner without <br />adequate provisions for the animal's proper care. <br /> <br />B. Criminal Negligence. A person acts wi th <br />criminal negligence when, through a gross deviation <br />from the standard of care that a reasonable person <br />would exercise, the person fails to perceive a <br />substantial and unjustifiable risk that a result <br />will occur or that a circumstance exists. <br /> <br />C. Harboring or Keeping. The occupant of any premises <br />on which an animal is kept, or to which an animal <br />customarily returns daily for food and care, is <br />presumed to be "harboring" or "keeping" .the animal <br />within the meaning of this title, and such persons <br />shall be subject to the provisions of this title. <br /> <br />D. Leash. A substantial chain, cord, rope or similar <br />device sufficient to hold an animal in restraint, <br />and which is not more than fifteen (15) feet in <br />length. <br /> <br />E. Mistreatment. Every act or omission which causes <br />or unreasonably permi ts the continuation of <br />unnecessary or unjustifiable pain or SUffering. <br /> <br />1 <br />
