PROPERTY LOCATED GENERAlLY <br />SOUTII OF CHERRY STREEr AND WEST OF COAL CREEK RANCH. WInCH IS OWNED BY THE <br />MEADOWS AT COAL CREEK CORPORATION. <br /> <br />WHEREAS. the City Council of the City of Louisville, Colorado, hereby determines that the parcel of real <br />property described below is owned by TIlE MEADOWS AT COAL CREEK CORP.; and, <br /> <br />y <br /> <br />WHEREAS. not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with <br />the City limits of the City of Louisville; and, <br /> <br />WHEREAS. a community of interest exists between the territory proposed to be annexed and the City of <br />Louisville; and, <br /> <br />WHEREAS. an annexation election of qualified electors is not required for this annexation. <br /> <br />NOW. THEREFORE. BE IT ORDAINED BY THE OTY COUNOL OF THE OTY OF LOUISVILlE. <br />COWRADO; <br /> <br />Section 1. That the following described property situated in the County of Boulder, State of Colorado, be annexed <br />to the City of Louisville. to wit: <br /> <br />See attached "Exhibit A", incorporated herein by this reference. <br /> <br />Section 2. That said territory is hereby annexed to the City of Louisville and included within the corporate <br />boundaries thereof as an integral part of the City. <br /> <br />Section 3. This Ordinance shall take effect on such date as the Planning Commission of the City of Louisville <br />approves the Final Subdivision Plat and Final PUD Development Plan for The Meadows at Coal Creek, copies <br />of which are attached hereto as Exhibits Band C, or thirty days after final publication of this Ordinance, <br />whichever is later. If the Planning Commission does not approve the attached Final Subdivision Plat and Final <br />PUD Development Plan, this Ordinance shall not become effective. If the Planning Commission approves the <br />attached Final Subdivision Plat and Final PUD Development Plan, but with amendments or additional conditions, <br />this Ordinance shall not take effect until such time, if ever, that the City Council approves the same amendments <br />approved by the Planning Commission. If any court review of the approval of the Final Subdivision Plat or Final <br />PUD Development Plan is timely rued, the City Council may repeal this Ordinance and thereby disconnect the <br />described property, to which repeal and disconnection the Owners hereby consent by their signatures appearing <br />below. This Section 3 shall constitute an amendment to the annexation agreement between the Owners and the <br />City. <br /> <br />TIlE OWNERS OF TIlE MEADOWS AT COAL CREEK HEREBY CONSENT TO TIlE FOREGOING <br />ORDINANCE, AS AMENDED AND ADOPfED ON SECOND READING.
