RESOLUTION NO. 5 <br /> SERIES 2014 <br /> A RESOLUTION APPROVING A PRELIMINARY SUBDIVISION PLAT AND <br /> PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) FOR AN APPROXIMATE 4 <br /> ACRE PARCEL OF THE TAKODA SUBDIVISION ALLOWING THE DEVELOPMENT <br /> OF 24 RESIDENTIAL UNITS. <br /> WHEREAS, there has been submitted to the Louisville City Council an <br /> application for approval of a preliminary subdivision plat and preliminary planned unit <br /> development (PUD) plan for the proposed Lanterns development located in northeast <br /> Louisville; and, <br /> WHEREAS, all materials related to the preliminary subdivision plat and <br /> preliminary planned unit development (PUD) plan have been reviewed by City Staff and <br /> the Planning Commission and found, subject to conditions, to be in compliance with the <br /> Louisville zoning ordinances, subdivision regulations, and related policies; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found <br /> that, subject to conditions, the application complies with the Louisville zoning and <br /> subdivision regulations and other applicable sections of the Louisville Municipal Code; <br /> and, <br /> WHEREAS, after duly noticed public hearing where evidence and testimony was <br /> entered into the record, including without limitation the findings in the Louisville <br /> Planning Commission Staff Report dated December 12, 2013, the City of Louisville <br /> Planning Commission approved a resolution to forward a recommendation of approval, <br /> with conditions to the City Council; and, <br /> WHEREAS, City Council has reviewed the application, including the <br /> recommendation of the Planning Commission and finds that said preliminary <br /> subdivision plat and preliminary planned unit development (PUD) plan should be <br /> approved, subject to the following conditions: <br /> 1. The plat shall be updated to reflect the land swap, contingent upon approval of <br /> the swap by City Council. <br /> 2. A maintenance easement shall be provided for the sidewalks. <br /> 3. The developer shall construct the curbs, crosswalk, and gutter for the Kaylix <br /> Avenue extension, and provide funds for the construction of the street to the <br /> southern edge of the development. <br /> 4. The applicant shall provide turning templates acceptable to the Louisville Public <br /> Works Department and the Louisville Fire Protection District before the City <br /> Council hearing. <br /> 5. A six foot fence shall be installed along the north edge of the development. <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Louisville, Colorado, based on the evidence and testimony presented at the hearings, <br /> does hereby approve the preliminary subdivision plat and preliminary planned unit <br /> Resolution No.5,Series 2014 <br /> Page 1 of 2 <br />
