ORDINANCE NO. 1657 <br /> SERIES 2014 <br /> AN ORDINANCE AUTHORIZING THE CONVEYANCE OF A PORTION OF A <br /> PARCEL OF OPEN SPACE OWNED BY THE CITY IN EXCHANGE FOR PARCELS <br /> OWNED BY SUMMIT VIEW PROFESSIONAL PARK LLC AND RMCS LLC TO BE <br /> DESIGNATED OPEN SPACE TO DIRECTLY AND SUBSTANTIALLY ADVANCE <br /> THE OPEN SPACE GOALS OF THE CITY <br /> WHEREAS, the City of Louisville is the owner of a parcel of land known as Outlot A, <br /> Summit View, a portion of which parcels is described in Exhibit A attached hereto (hereinafter <br /> "City Parcel"); and <br /> WHEREAS, Summit View Professional Park LLC is the owner of a parcel of land <br /> known as Lot 3, Block 11, Takoda subdivision and a parcel of land known as Tract M, Takoda <br /> subdivision, and RMCS LLC is the owner of a parcel of land known as Tract K, Steel Ranch <br /> South subdivision, portions of all of which are described in Exhibit A attached hereto <br /> (hereinafter "Private Parcels"); and <br /> WHEREAS, section 15-6(b)(3) of the Louisville City Charter authorizes the City to <br /> make the transfer of any property interest in or relating to open space land that substantially and <br /> directly advances the open space goals of the City if approved by two-thirds (2/3) of the entire <br /> City Council following favorable recommendation by the Open Space Advisory Board; and <br /> WHEREAS, exchanging the City Parcel for the Private Parcels is consistent with good <br /> stewardship and sound ecological principles, will preserve and promote native plants, native <br /> wildlife, and their habitats, and will promote passive recreation activities by allowing for the <br /> creation of a trail network; and <br /> WHEREAS, a core value of the City in the 2013 Comprehensive plan promotes: <br /> "Integrated Open Space and Trail Networks... where the City appreciates, manages and <br /> preserves the natural environment for community benefit, including ecological diversity, its <br /> outstanding views, clear-cut boundaries, and the interconnected, integrated trail network which <br /> makes all parts of the City accessible" and exchanging the City Parcel for the Private Parcels <br /> strengthens the City's open space and trail networks; and <br /> WHEREAS, the City Parcel and the Private Parcels are of equal size, both 6,538 square <br /> feet; and <br /> WHEREAS, the Open Space Advisory Board gave a favorable recommendation to <br /> exchanging the City Parcel for the Private Parcels at their November 6, 2013 meeting, based <br /> upon findings including without limitation those in the staff memo dated November 6, 2013; and <br /> WHEREAS, the City Council has duly considered the Open Space Advisory Board's <br /> recommendation; and <br /> Ordinance No. 1657, Series 2014 <br /> Page 1 of 7 <br />
