RESOLUTION NO. 19 <br />SERIES 2014 <br />A RESOLUTION APPROVING A NATURAL GAS PIPELINE EASEMENT WITH <br />PUBLIC. SERVICE COMPANY OF COLORADO IN CONJUNCTION WITH THE <br />US36/MCCASLIN BOULEVARD DIVERGING DIAMOND INTERCHANGE PROJECT <br />WHEREAS, the Colorado Department of Transportation ( "CDOT ") plans to design and <br />construct a diverging diamond interchange at U.S. 36 and McCaslin Boulevard (the "Project "); and <br />WHEREAS, the City Council by resolution previously approved a contract with CDOT <br />regarding the City's contribution to funding of the Project and related matters concerning the <br />design and construction of the Project; and <br />WHEREAS, as part of the Project, it is necessary for Public Service Company of Colorado <br />( "PSCO ") to relocate, to property owned by the City, portions of two natural gas pipelines located <br />in the vicinity of the interchange; and <br />WHEREAS, PSCO has requested an easement for such purpose, and the City is willing to <br />grant an easement for the relocated pipelines upon terms and conditions mutually acceptable to the <br />City and PSCO; and <br />WHEREAS, the City by this Resolution desires to approve the grant of easement and <br />authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The proposed Public Service Company of Colorado Gas Easement ( "Easement ") <br />between the City of Louisville, as grantor, and Public Service Company of Colorado, as grantee, <br />for the conveyance of a 50 -foot wide easement for the relocation of one gas transmission line and <br />one gas distribution line across portions of the City -owned property located adjacent the U.S. 36 <br />and McCaslin Boulevard interchange, is hereby approved in essentially the same form as the <br />copy of such Easement accompanying this Resolution. <br />2. The Mayor is authorized to execute the Easement on behalf of the City, except <br />that the Mayor is hereby granted the authority to negotiate and approve such revisions to said <br />Easement as the Mayor and City Manager determine are necessary or desirable for the protection <br />of the City, so long as the essential terms and conditions of the Easement are not altered. <br />PASSED AND ADOPTED this 15' day of , 2014. <br />Robert P.
