RESOLUTION NO. 19 SERIES 2014 A RESOLUTION APPROVING A NATURAL GAS PIPELINE EASEMENT WITH PUBLIC. SERVICE COMPANY OF COLORADO IN CONJUNCTION WITH THE US36/MCCASLIN BOULEVARD DIVERGING DIAMOND INTERCHANGE PROJECT WHEREAS, the Colorado Department of Transportation ( "CDOT ") plans to design and construct a diverging diamond interchange at U.S. 36 and McCaslin Boulevard (the "Project "); and WHEREAS, the City Council by resolution previously approved a contract with CDOT regarding the City's contribution to funding of the Project and related matters concerning the design and construction of the Project; and WHEREAS, as part of the Project, it is necessary for Public Service Company of Colorado ( "PSCO ") to relocate, to property owned by the City, portions of two natural gas pipelines located in the vicinity of the interchange; and WHEREAS, PSCO has requested an easement for such purpose, and the City is willing to grant an easement for the relocated pipelines upon terms and conditions mutually acceptable to the City and PSCO; and WHEREAS, the City by this Resolution desires to approve the grant of easement and authorize its execution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Public Service Company of Colorado Gas Easement ( "Easement ") between the City of Louisville, as grantor, and Public Service Company of Colorado, as grantee, for the conveyance of a 50 -foot wide easement for the relocation of one gas transmission line and one gas distribution line across portions of the City -owned property located adjacent the U.S. 36 and McCaslin Boulevard interchange, is hereby approved in essentially the same form as the copy of such Easement accompanying this Resolution. 2. The Mayor is authorized to execute the Easement on behalf of the City, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Easement as the Mayor and City Manager determine are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Easement are not altered.
