RESOLUTION NO. 20 <br />SERIES 2014 <br />A RESOLUTION APPROVING A GRANT AGREEMENT WITH THE COLORADO <br />DEPARTMENT OF PUBLIC SAFETY, DIVISION OF HOMELAND SECURITY AND <br />EMERGENCY MANAGEMENT FOR FLOOD - RELATED DEBRIS REMOVAL <br />WHEREAS, pursuant to federal law, the President of the United States declared certain <br />Colorado counties as disaster areas and available for federal assistance due to the flooding that <br />occurred in September 2013 and issued a "Presidential Declaration" in connection therewith; and <br />WHEREAS, pursuant to state law, the Colorado Governor also declared a disaster <br />emergency in certain Colorado counties due to the flooding that occurred in September 2013 and <br />issued a "Governor's Order" in connection therewith; and <br />WHEREAS, as a result of such flooding, large amounts of debris, including trees, woody <br />vegetation, brush, sand, siltation and concrete debris, accumulated and were deposited in the City's <br />rights -of -way, ditches, trails and other areas within the City, and such debris has been or needs to be <br />removed; and <br />WHEREAS, pursuant to the "Presidential Declaration" and other federal law, including <br />without limitation the Robert T. Stafford Disaster Relief and Emergency Assistance Act, federal <br />funds have been allocated for flood - related projects requested by the State and local agencies; and <br />WHEREAS, pursuant to State law, including without limitation C.R.S. §§ 29 -1 -203 and 24- <br />1- 128.6, the State of Colorado, acting by and through the Department of Public Safety, Division of <br />Homeland Security and Emergency Management (the "State "), and local agencies are authorized to <br />contract for the funding for projects performed by the local agency; and <br />WHEREAS, there has been proposed between the State and the City of Louisville a Grant <br />Agreement ( "Agreement ") to provide for the disbursement of Federal, State and/or other funds to <br />the City pursuant to the "Presidential Declaration" and "Governor's Order" for funding debris <br />removal projects in the City; and <br />WHEREAS, the City Council finds that the proposed Agreement is in the best interests of <br />the City and its citizens, and by this resolution desires to approve the Agreement, authorize its <br />execution, and authorize certain actions in connection therewith; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The City Council hereby approves that certain Grant Agreement between the City <br />of Louisville and the State of Colorado, acting by and through the Department of Public Safety, <br />Division of Homeland Security and Emergency Management (the "State "), for disbursement of <br />Federal, State and/or other funds to the City pursuant to the "Presidential Declaration" and <br />"Governor's Order," for funding City debris removal projects resulting from the September 2013 <br />Resolution No. 20, Series 2014 <br />Page 1 of 2 <br />
