ORDINANCE NO. 1661 <br />SERIES 2014 <br />AN ORDINANCE AMENDING THE LOUISVILLE MUNICIPAL CODE TO ESTABLISH <br />MARIJUANA OFFENSES <br />WHEREAS, Article XVIII, § 16 of the Colorado Constitution, referred to as Amendment <br />64, was approved by Colorado voters in November 2012; and <br />WHEREAS, Amendment 64 legalized the private use of marijuana for persons twenty - <br />one years of age or older; and <br />WHEREAS, the City Council desires to establish marijuana offenses punishable in the <br />Louisville Municipal Court; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Louisville Municipal Code is hereby by amended by the addition of a <br />new Chapter 9.76 to read as follows: <br />Chapter 9.76 <br />MARIJUANA OFFENSES <br />Sec. 9.76.010. Definitions. <br />Sec. 9.76.020. Possession and consumption of marijuana by minors; affirmative <br />defense. <br />Sec. 9.76.030. Public consumption of marijuana prohibited. <br />Sec. 9.76.040. Violation; penalty. <br />Sec. 9.76.010. Definitions. <br />As used in this chapter, the following words and phrases shall have the <br />following meanings: <br />Marijuana shall have the same meaning as set forth in Article XVIII, § <br />16(2)(f) of the Colorado Constitution. <br />Marijuana product shall have the same meaning as set forth in Article <br />XVIII, § 16(2)(k) of the Colorado Constitution. <br />Minor shall mean any person under the age of twenty -one (21). <br />Registry identification card shall have the same meaning as set forth in <br />Article XVIII, § 14(1)(g) of the Colorado Constitution, or as may be more fully <br />defined in any applicable state law or regulation. <br />1 <br />
