ORDINANCE NO. 1665, <br />SERIES 2014 <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO <br />DEFINE FOOD TRUCKS, FOOD CARTS, AND MOBILE RETAIL FOOD <br />ESTABLISHMENTS AND ADOPT REGULATIONS ADDRESSING THEIR ALLOWED <br />OPERATIONS WITHIN LOUISVILLE. <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation <br />duly organized and existing under laws of the State of Colorado and the City Charter; <br />and <br />WHEREAS, the popularity of food trucks, food carts and mobile retail food <br />establishments have increased significantly in recent years; and <br />WHEREAS, the zoning ordinances within the Louisville Municipal Code (LMC) do <br />not specifically recognize food trucks, food carts and mobile retail food establishments <br />nor their unique operating characteristics; and <br />WHEREAS, the City Council desires to clearly define food trucks, food carts and <br />mobile retail food establishment and adopt regulations addressing their allowed <br />operations within Louisville; and <br />WHEREAS, a core value of the City in the 2013 Comprehensive Plan promotes: <br />"A Healthy, Vibrant, and Sustainable Economy ... where the City understands and <br />appreciates the trust our residents, property owners, and business owners place in it <br />when they invest in Louisville, and where the City is committed to a strong and <br />supportive business climate which fosters a healthy and vibrant local and regional <br />economy for today and for the future"; <br />WHEREAS, the City Council finds that defining food trucks, food carts and <br />mobile retail food establishments and their allowed operations within Louisville will serve <br />to clarify permissible uses and activities associated with the mobile food industry and <br />promote a balance of uses among mobile food industry uses and established "brick and <br />mortar" restaurants; and <br />WHEREAS, a second core value of the City in the 2013 Comprehensive Plan <br />promotes: Unique Commercial Areas and Distinctive Neighborhoods ... where the City <br />is committed to recognizing the diversity of Louisville's commercial areas and <br />neighborhoods by establishing customized policies and tools to ensure that each <br />maintains its individual character, economic vitality, and livable structure', and <br />WHEREAS, the City Council finds it is necessary and appropriate that any new <br />regulations regarding food trucks, food carts and mobile retail food establishments <br />contain nuisance mitigation measures to ensure each neighborhood commercial area <br />maintains their unique character and livable structure; and <br />Ordinance No. 1665, Series 2014 <br />Page 1 of 9 <br />
