REPLAT C <br />WHEREAS, by the Business Center at C.T.C. Replat C recorded in the Office of the <br />Boulder County Clerk and Recorder on January 24, 2001 at Reception No. 2112641 there was <br />dedicated to the City a 20 foot drainage and utility easement on the common lot line between Lot 2 <br />and Lot 4, Block 5, and partially on the common lot line between Lot 1 and Lot 3, Block 5, in the <br />location further described in Exhibit A attached hereto and incorporated herein by this reference <br />( "the 20 foot Easement "); and <br />WHEREAS, the Owner of Lots 1, 2, 3 and 4, who intends to develop said Lots under a <br />single planned unit development plan, has requested vacation of the 20 foot Easement; and <br />WHEREAS, the City Council finds and determines that the 20 foot Easement for which <br />vacation is requested is not and will not be needed for any public purposes and will not be needed <br />for any City utility or drainage purposes; and <br />WHEREAS, the City Council finds and determines that the 20 foot Easement for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the 20 foot Easement for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of that certain 20 -foot wide drainage <br />and utility easement located on the common lot line between Lot 2 and Lot 4, Block 5 and partially <br />on the common lot line between Lot 1 and Lot 3, Block 5, the Business Center at C.T.C. Replat C, <br />which easement herein vacated is in the location further described in Exhibit A attached hereto and .7 <br />incorporated herein by this reference ( "the 20 foot Easement "). <br />Section 2. No other easements for public utilities per The Business Center at C.T.C. <br />Replat C shall be deemed altered or amended by virtue of this ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br />Section 4. The Mayor: and City Manager, or either of them, is authorized to execute <br />such additional documents as may be necessary to evidence the vacation of the 20 foot Easement <br />access easements herein vacated, including but not execution of quit claim deeds.
