ORDINANCE NO. 1673 <br />SERIES 2014 <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO <br />ADOPT AN ADMINISTRATIVE PROCEDURE FOR CERTAIN VARIANCE REQUESTS <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br />organized and existing under laws of the State of Colorado and the City Charter; and <br />WHEREAS, Chapter 17.52 of the Louisville Municipal Code sets forth provisions relating <br />to the administration and enforcement of Title 17; and <br />WHEREAS, Section 17.52.050 of the Louisville Municipal Code sets forth certain powers <br />and duties of the Zoning Administrator; and <br />WHEREAS, Section 17.52.050.D of the Louisville Municipal Code current states, "The <br />Zoning Administrator is under no circumstances permitted to grant an exception to the actual <br />meaning of any clause, order or regulation contained in this title to any person making application <br />to construct, move, alter or use either a building, a structure or land "; and <br />WHEREAS, Section 17.52.050E of the Louisville Municipal Code currently states, "The <br />Zoning Administrator is under no circumstances permitted to make changes in this title or to vary <br />the terms of this title in carrying out his duties as Zoning Administrator "; and <br />WHEREAS, Section 17.52.030 of the Louisville Municipal Code sets forth certain <br />responsibilities of the Board of Adjustment and states such Board shall hear and decide all questions <br />on appeal from decisions of the zoning administrator, and all other questions as provided in chapter <br />17.48; and <br />WHEREAS, the City Council desires to adopt a more expedient administrative process to <br />review minor impact variances to Title 17 standards; and <br />WHEREAS, the City Council also desires to a more expedient administrative process to <br />review specific variances to lot coverage standards for property owners within Planned Unit <br />Developments that do not have specific lot coverage requirements and a lot size difference from the <br />underlying zoning code; and <br />WHEREAS, for such purposes, the City Council desires to amend Chapter 17.52 and other <br />provisions of Title 17 of the Louisville Municipal Code to provide for an administrative variance <br />procedure under which the Zoning Administrator is authorized to approve minor variances that fit <br />stated criteria; and <br />WHEREAS, a core value of the City in the 2013 Comprehensive Plan promotes: "Our <br />Livable Small Town Feel ... where the City's size, scale, and land use mixture and government's <br />Ordinance No. 1673, Series 2014 <br />Page 1 of 9 <br />
