ORDINANCE NO. 1673 SERIES 2014 AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT AN ADMINISTRATIVE PROCEDURE FOR CERTAIN VARIANCE REQUESTS WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly organized and existing under laws of the State of Colorado and the City Charter; and WHEREAS, Chapter 17.52 of the Louisville Municipal Code sets forth provisions relating to the administration and enforcement of Title 17; and WHEREAS, Section 17.52.050 of the Louisville Municipal Code sets forth certain powers and duties of the Zoning Administrator; and WHEREAS, Section 17.52.050.D of the Louisville Municipal Code current states, "The Zoning Administrator is under no circumstances permitted to grant an exception to the actual meaning of any clause, order or regulation contained in this title to any person making application to construct, move, alter or use either a building, a structure or land "; and WHEREAS, Section 17.52.050E of the Louisville Municipal Code currently states, "The Zoning Administrator is under no circumstances permitted to make changes in this title or to vary the terms of this title in carrying out his duties as Zoning Administrator "; and WHEREAS, Section 17.52.030 of the Louisville Municipal Code sets forth certain responsibilities of the Board of Adjustment and states such Board shall hear and decide all questions on appeal from decisions of the zoning administrator, and all other questions as provided in chapter 17.48; and WHEREAS, the City Council desires to adopt a more expedient administrative process to review minor impact variances to Title 17 standards; and WHEREAS, the City Council also desires to a more expedient administrative process to review specific variances to lot coverage standards for property owners within Planned Unit Developments that do not have specific lot coverage requirements and a lot size difference from the underlying zoning code; and WHEREAS, for such purposes, the City Council desires to amend Chapter 17.52 and other provisions of Title 17 of the Louisville Municipal Code to provide for an administrative variance procedure under which the Zoning Administrator is authorized to approve minor variances that fit stated criteria; and WHEREAS, a core value of the City in the 2013 Comprehensive Plan promotes: "Our Livable Small Town Feel ... where the City's size, scale, and land use mixture and government's Ordinance No. 1673, Series 2014 Page 1 of 9
