ORDINANCE NO. 1676 <br />SERIES 2014 <br />AN ORDINANCE ADOPTING A CITY POLICY ADDRESSING DEFENSE AND <br />INDEMNIFICATION OBLIGATIONS TO CITY OFFICIALS AND EMPLOYEES <br />WHEREAS, the City recognizes the need to encourage elected and appointed officials <br />and municipal employees to effectively and efficiently perform their duties and to protect such <br />individuals in the performance of such duties; and <br />WHEREAS, to this end, the City Council desires to adopt and codify a City policy <br />addressing defense and indemnification of City officials and employees against claims and <br />causes of action which might arise in the performance of their duties for the City; and <br />WHEREAS, the City Council finds that adoption of such a policy is in the best interests <br />of the City and in furtherance of applicable law, including the Colorado Governmental Immunity <br />Act, C.R.S. § 24 -10 -101 et sea. ( "the Act "), which Act sets forth certain obligations of the City <br />to defend and indemnify City elected and appointed officials and employees against liabilities <br />arising in the performance of their duties. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Title 2 of the Louisville Municipal Code is hereby by amended by the <br />addition of a new Chapter 2.06 reading as follows: <br />Chapter 2.06 <br />DEFENSE AND INDEMNIFICATION OBLIGATIONS TO CITY OFFICIALS AND <br />EMPLOYEES <br />Sec. 2.06.010. Public employee defined. <br />Sec. 2.06.020. City's defense and indemnification obligations to employees. <br />Sec. 2.06.030. Legal representation of employees. <br />Sec. 2.06.040. Reimbursement of employees' attorneys' fees in criminal matters. <br />Sec. 2.06.050. No liability to third parties. <br />Sec. 2.06.010. Public employee defined. <br />When used in this Chapter, the terms public employee and employee shall have the same <br />meaning as the term "public employee" is given in the Colorado Governmental Immunity Act, <br />Section 24- 10- 103(4), C.R.S. In addition, these terms shall include within their meaning any <br />official of a board, commission, authority, task force or committee (hereinafter referred to <br />collectively, "board or commission ") appointed by the City Council and who is also subject to <br />removal by the City Council, whether or not such board or commission is itself under the control <br />of the City Council.
