ORDINANCE NO. 1692 <br />SERIES 2015 <br />AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE CITY OF <br />LOUISVILLE, COLORADO; AMENDING CERTAIN SECTIONS OF THE <br />LOUISVILLE MUNICIPAL CODE CONCERNING FLASHING YELLOW SIGNALS <br />AND DRIVING THROUGH PRIVATE PROPERTY. <br />WHEREAS, pursuant to section 42- 4- 110(1)(b), C.R.S., municipalities may in the <br />manner prescribed by article 16 of title 31, C.R.S., adopt by reference all or, any part of a model <br />municipal traffic code that embodies the rules of the road and vehicle requirements as set out in <br />the state traffic laws; and <br />WHEREAS, the City has adopted the 2010 edition of the Model Traffic Code for <br />Colorado promulgated and published by the Colorado Department of Transportation for the <br />purpose of providing a system of traffic regulations consistent with state law and generally <br />conforming to similar regulations throughout the state and the nation; and <br />WHEREAS, the City has adopted certain additions, amendments and deletions to <br />specific sections of Parts 1 -19 of the Model Traffic Code to further clarify traffic laws; and <br />WHEREAS, the Federal Highway Administration published the 2009 Edition of the <br />Manual on Uniform Traffic Control Devices for Streets and Highways defining and prescribing a <br />flashing yellow arrow as a national traffic signal indication to be used where permissive turns are <br />allowed from dedicated turn lanes; and <br />WHEREAS, the City Council desires to amend the Louisville Municipal Code to add the <br />regulatory meaning of a flashing yellow arrow and to further protect public health and safety by <br />prohibiting drivers from driving across private property to avoid traffic signals or to save time. <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Section 10.04.020 of the Louisville Municipal Code is hereby amended by <br />the addition of the following provisions, which shall be added to such section in numerical order: <br />Section 904, Flashing Yellow Signal, is added to read as follows: <br />904. Flashing Yellow Signal, <br />(1) It is unlawful to proceed on a yellow flashing arrow unless it is safe to <br />do so. A driver facing a traffic control signal when the yellow arrow <br />lens of the signal is illuminated with rapid intermittent flashes is <br />warned that opposing traffic has the right of way and the driver should <br />proceed with caution. <br />Ordinance No. 1692, Series 2015 <br />Page 1 of 3 <br />
