Recorded as received. <br />ORDINANCE NO. 1713 <br />SERIES 2016 <br />AN ORDINANCE APPROVING THE VACATION OF VARIOUS EASEMENTS WITHIN <br />LOT 1, BLOCK 9 AND TRACT T, TAKODA SUBDIVISION AND LOT 2 OF SUMMIT <br />VIEW <br />WHEREAS, by the Summit View Subdivision recorded in the Office of the Boulder <br />County Clerk and Recorder on November 6, 2001 at Reception No. 2216330, and by the Takoda <br />Subdivision recorded in the Office of the Boulder County Clerk and Recorder on October 6, 2010 <br />at Reception No. 3103584 there was dedicated to the City various utility easements on Lot 1, Block <br />9, in the location further described in Exhibit A attached hereto and incorporated herein by this <br />reference ( "Easements "); and <br />WHEREAS, the Owner of Lot 1, who intends to develop said Lot under a single planned <br />unit development plan, has requested vacation of the Easements; and <br />WHEREAS, the City Council finds and determines that the Easements for which vacation <br />is requested is not and will not be needed for any public purposes and will not be needed for any <br />City utility or drainage purposes; and <br />WHEREAS, the City Council finds and determines that the Easements for which vacation <br />is requested is not being used or held for park purposes or for any other governmental purposes; and <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the Easements for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of the various easements located Lot <br />1, Block 9 and Tract T, Takoda Subdivision and Lot 2 of Summit View Subdivision, which <br />easement herein vacated is in the location further described in Exhibit A attached hereto and <br />incorporated herein by this reference ( "the Easements "). <br />Section 2. No other easements for public utilities per Takoda Subdivision shall be <br />deemed altered or amended by virtue of this ordinance. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br />Section 4. The Mayor and City Manager, or either of them, is authorized to execute <br />such additional documents as may be necessary to evidence the vacation of the Easements herein <br />vacated, including but not execution of quit claim deeds. All action heretofore taken in furtherance <br />of the vacation the Easements are hereby ratified and confirmed. <br />Ordinance No. 1713, Series 2016 <br />Page 1 of 2 <br />
